How's this for a scenario? Trump resigns, and then Pence pardons him!

    There's no 'link' that I'm aware of for this concept, but it is an 'opinion', so the thread is probably safe for discussion.

    How about this for a scenario? Trump resigns (with a whole whopping twelve days to go), Mike Pence becomes president immediately, whereupon he pardons Trump, and maybe a few others, too.

    Despite what Trump has alluded to in some of his recent musings, no one really believes that a sitting president has the ability to PARDON HIMSELF. So... what's left for Trump?

    You know that Democrats smell 'blood in the water' like never before and that they'll be after Trump's ass like a runaway chainsaw the first chance they get when they can lay hands on him outside the Oval Office!

    If it happens this way, it'll be the stuff of a blockbuster movie! Your thoughts?

    That has been my thinking for a long time. Until now. Now I'm not so sure after Wednesday's events.

    I understand that Pence is furious with Trump after he failed to protect him when he was hiding in the Capitol and Trump supporters chanted "Hang Mike Pence!" "Hang Mike Pence!"

    So I'm not sure Pence would participate. And that would mean Trump will be doing jail time.

    We'll hit bottom as a country if Trump is prosecuted for anything. We're almost at rock bottom banana republic status now but that would cinch it.

    Too late. We hit rock bottom on 1/6/2021 when Trump’s thugs broke into the Capitol.

    Thoughts: You are thinking like a rational person would. But that is not how Trump thinks. Trump believes himself to be the greatest president ever. That he has done nothing wrong.

    Why should I resign? That is for losers and chumps. Me, resign?? Waive the white flag like I've lost? That will never happen. The greatest president in history doesn't waive the white flag to his enemies.

    No, he will pardon himself.

    Not because I did anything wrong, of course not. It is because the democrats, who hate me so much, and are so terrible. Even now they are engaging in another witch hunt to pursue me even after I leave office. They will never let me rest. This is the only way.


    He has the absolute right to pardon himself (according to himself). It will be his final act. Right after pardoning his children, Rudy, and any other friends and allies who have been so loyal. So loyal.

    A couple of things.

    Trump put Pence's life in danger by refusing to send the national guard while rioters were in the Capitol shouting "hang Pence!" over and over. Pence is probably not having warm fuzzies about him.

    Trump has already stated he won't resign. Once The House impeaches him next week, Pence won't be able to pardon him, anyway.

    I never listened to his press conferences because he literally has the syntax of a 3rd grader(no offense to third graders who's syntax is appropriate for their age unlike the 70 year old traitor.)

    Why does no one believe it?

    Nothing says he can't and the Supreme Court isn't going to mess with it.

    Congress would have to change it.

    Oh I would love for him to try. Once SCOTUS strikes it down, Trump can be charged and face consequences for his actions.

    He didn't "fail to protect him" he threw him under the bus. I wouldn't look for any help there.

    This idea has been tossed around for well over a year now.

    First, I doubt Trump will resign. It makes him look 'weak' and he'll avoid that at any cost.

    If he did, I doubt Pence will pardon. why? Trump threw him under the bus. Half of his minions were searching for him and I think they wanted to lynch him because he didn't hand Trump the election ( though he was bound by law to accept the electors chosen by the states but Trump is too stupid to understand it ).

    Anyway....

    Ain't gonna happen.

    the more likely scenario is that Trump is going to pardon his family , associates, and himself.

    Obstruction of justice comes to mind. That is where the challenge would come from. No one tested preemptive pardons given by Ford and Carter because they were frankly the right thing to do. There will be challenges if T**** tries and after having thrown them under the bus as he did Pence I'd not count on SCOTUS if I were him. What bridges has he not burned?

    On what grounds would they strike it down?

    They have never shown any desire to mess with that power as it is extremely clear how much latitude the president was given.

    Don't you think any of the founders considered using it for himself?

    Do you think they were idiots?

    They were fully aware that a president may pardon himself but they took no action to restrict it.

    You can't base a law on opinion.

    Nobody challenged them because there are no grounds to challenge it.

    Simply saying it's not right is not going to work in a court.

    No man can be his own judge. Justice department said that during Nixon's term.

    But I would love for Trump to try it out. If he wins, he's a free man. If he loses, he's going to federal prison.

    The pardon power has nothing to do with judging anyone, it has one purpose, to put someone above the law.

    That's it. It was meant to let guilty people go free.

    There is no person alive today that has been more investigated than President Trump. Comparatively speaking he is probably the cleanest guy in DC. I see no reason that he needs a pardon.

    As for this nonsense about Incitement: Under federal law, incitement to riot does not include ‘advocacy of ideas’ or ‘expression of belief’ unless it endorses violence, which Trump did not do.

    It amazing that folks claiming to be expert in the law would make such foolish claims and that they so badly want to establish a new precedent that speakers who neither commit nor advocate violence can be prosecuted for the criminal conduct of people inspired by their words.

    I doubt they would even take it. The court rarely gets involved in disputes between the legislative and the executive branch.

    Their reasoning would be that if they had an issue with it then they should have fixed before this problem, not afterwards.

    I think the very fact that nobody can come with a single reason why he couldn't says all that needs to be said.

    I just gave you a reason. A man cannot be his own judge.

    And your reasoning is incorrect. They are not trying to fix or change any law or statute, they merely want SCOTUS to interpret the constitution, which is their job. This is actually the perfect case for SCOTUS to take as the purpose of SCOTUS is to balance the power of the executive branch.

    once the impeachment proceedings start next week, it's possible he will resign

    it's the only why to stop from bing know as the one term 2x impeached President

    He shouldn't be given the opportunity to resign. He should be ousted NOW. And no pardon; this pariah should pay for his crimes.
