KYLE RITTENHOUSE’S OFFENSE https://www.powerlineblog.com/archives/2021/11/kyle-rittenhouses-offense.php Snip… Quite true. It invades society to the point of political prosecution like the Rittenhouse trial that should never have taken place other than left wing political pressure.
To prove the point. WATCH: BLM Calls for Federal Murder Charges Against Rittenhouse https://www.breitbart.com/politics/...r-federal-murder-charges-against-rittenhouse/
These idiots really don't have a clue about the justice system. There's such a thing as double jeopardy. And yes, federal charges fall under the same guidelines. It's no longer possible to charge Rittenhouse with regards to this case. You'd have to find a new and different criminal complaint. This has been Law 101 for the Liberal newbies.
The feds have not honored double jeopardy matters for years. This current version of DOJ under Biden is even more disgusting.
https://www.law.cornell.edu/wex/double_jeopardy A 1984 case(no pun intended) connected the double jeopardy rule to state cases. The standard law applies, they will not be able to charge Rittenhouse federally. Now they can sue for civil damages(good luck), but Rittenhouse by LAW is no longer criminally liable as ruled by the Supreme Court.
See also: Zimmerman case. The federal government couldn't pursue a case for much the same reason. You've got one shot and one shot only at a criminal case against an individual in this country(related to that specific offense.)
You are technically correct, but the DOJ and the rest of the federal government does not care what the law says. The story of Russiagate shows that. We live under a government of men, not a government of law.
From your link. In One Lot Emerald Cut Stones v. United States, 409 U.S. 232 (1972), the Supreme Court held, "Congress may impose both a criminal and a civil sanction in respect to the same act or omission, for the Double Jeopardy Clause prohibits merely punishing twice, or attempting a second time to punish criminally, for the same offense." But does that apply to the administration?
It’s over. No court will entertain this case again. Watching right now local ABC reporting about the families may sue. Waste of time. You couldn’t find an untainted jury at this point. The only suits now will be Rittenhouse eviscerating MSNBC and CNN
If you read into the ruling carefully, the keywords are "criminal AND a civil sanction." In other words, it's possible for Congress to impose a separate criminal sanction with a civil sanction. Congress is however not permitted to "punish twice or attempt a second time to punish criminally, for the same offense"
That's not traditionally how the double jeopardy rule is viewed. Simply bringing an accusation to a defendant in a trial is an 'attempt to punish criminally'. If it were viewed the way you propose, defendant rights would be nonexistent as they would keep trying and trying until they found a jury that would convict said defendant.
Yeah, Zimmerman is another great example, a hero of the gun-toting right. Now, you may have thought that Zimmerman would have learned from killing someone. But, no, he continued to use guns to solve his problems with continuous run ins with the law. A great role model, so keep bringing him up, righties. https://en.wikipedia.org/wiki/George_Zimmerman It will be seen if Rittenhouse will learn from his ordeal, or if he will be emboldened by the acquittal, sticking with his gun-toting ways and also having future run-ins with the law. Time will tell.
He is right. Rittenhouse can't be tried twice for the same crimes under Double Jeopardy laws. If there is a mistrial they can hold another trial as long as the mistrial charge by the judge is without prejudice.
I only brought Zimmerman up in relation the reality that Double Jeopardy is an enduring principle in judicial law. I could care less about his lifestyle or what he's done with it.
Watch this video from 1987 near Disney World at 2:30AM in the morning. Can you imagine those people having the absolutely insane arguments we have now? What would the voters have done to a President who called teenager (who defended himself against 4 convicted felon) a "white supremacist"? They have been boiling the frog for 60 years and now it is cooked. The dark winter is truly upon us. This is what they took from us:
Wikipedia is not a source. It’s a liberal think-tank. Type in any Conservative or Republican name on Wikipedia. 90% change Wikipedia is slandering their name with lies. Type in a Liberal or a Democrat, the complete opposite. Wikipedia says Golden Child.
Just another "Lookie! Lefties Bad!" OPINION Piece? What is an OPINION from an Extreme RW Blog doing in Current Events? Does PF's RW think that just b/c Rule 2 has been suspended (and they can crap all over the LW with impunity) that Rule 11 no longer applies? Just Wow...:smh: As to the actual OP Topic? I have never been a fan of Paul Mirengoff (or his OPINIONS). Mirengoff goes so far out of his way to pander to the Extreme RW, that he wouid find a way to "legally argue" that "2+2=5", if he thought that his delusional brain diarrhea would be spammed by RW Extremists across social media.
UNLESS Certain "Extenuating Circumstances" apply... Those exceptions don't seem to apply to KR's Case... Thus, Fed Charges seem unlikely.. https://www.fox10phoenix.com/news/c...house-judiciary-chairman-calls-for-doj-review
Some people just fight because they have nothing else to fill the mental void but a rolling MSNBCNN chron.
The dark winter is truly upon us. Hahaha, sadly you actually believe this I reckon. The bastion of freedom - our Kyle Rittenhouse supporters. It this the way all you folks would parent your 17 year old son? Drive him to a protest and drop him off with his wannabe paramedic / police kit? I'm just going by the name, but do you have a son that plays or played hockey? Skip that though, no time for hockey: you'd have given him a lift and dropped him off with a gun at a potential street fight?
Everything is ok, Trump said so. https://www.businessinsider.com/tru...enosha-rittenhouse-not-guilty-verdict-2021-11 Former President Donald Trump on Friday said he was "very happy" to see Kyle Rittenhouse fully acquitted of all charges, adding that he himself "helped save Kenosha" last year. Trump writes his own jokes.
