All 3 men guilty of murder in the killing of Ahmaud Arbery

    Getting closer to what I'm reviewing.
    To my knowledge, Arbery's killers wanted to question him but do not claim they knew he was engaged in an ongoing felony.
    Had they reasonably thought he was engaged in a serious ongoing crime, even if wrong, would have then had the right to act as they did?
    I think the guy that shoved a gun in Rittenhouse's face thought, incorrectly, that Rittenhouse was involved in a serious ongoing felony. Had he shot and killed him, would his incorrect belief have been a defense?

    He didn't have a phone on him. That's why.

    If he did, he is under no obligation to call police if he thinks any hesitation will cost him his life.

    I would be grateful if you could point us to any news articles saying that Arbery was not carrying a mobile phone at the time.

    Yes and yes, but only if the jury concluded that their subjective belief, in both cases, was reasonable.

    Well the jury on this one wasn't quite as big as the Rittenhouse one is.

    Let me point out that almost all of the evidence for this case comes from the testimony of the three who were then charged and found guilty of murder.
    Many are saying a murder conviction would not even have been possible if it was not for the mobile phone video one of them took.

    It seems these people were not trying to commit a murder or seriously break the law.
    They gave their own evidence that was then used to convict them.

    Surely that is an argument for mercy, even if you believe what happened was a murder.

    If they are sentenced life in prison, then in the future in a case like this, even law-abiding citizens might decide it is better to lie and destroy video evidence.

    But who created the emergency? The McMichaels did. Everything they did, right up to the last second, created the emergency. They were the aggressors, not Arbery.

    He didn't try to attack Travis McMichael, he tried to run around him. But like you said, Travis cornered him. Cornering him is being the aggressor. Travis created the physical confrontation by cornering him as you put it, not Arbery. Arbery was trying to escape until he was cornered.

    One second. One second from coming around the front of the truck to getting shot.

    And pulling the trigger, pumping the action, firing again, pumping the action again, and firing again is not an "understandable mistake".

    You are aware Arbery punched one of them?

    He was not a little guy either. Imagine getting punched by a pro boxer.

    Apparently they aren't aware. A sane person that hasn't done anything wrong doesn't run AT people with guns (not pointed or even pointed at them...which is what has been said but we know is false).

    I, for one, have had a gun pointed at my face....at close range. I damn sure didn't run at him and I damn sure didn't try to take the gun away.

    I've also had 3 blacks pointing what appeared to be 40 cal or 9mm glocks at me (all three had guns) from about about 40 feet away. I damn sure didn't run at them either....even thought it was on my own property.

    Yup. Without rehashing everything I've already pointed out to you, Arbery punching McMichael was legitimate self defense against aggressors, one of which who had cut him off from escape and was pointing a shotgun at him at arm's length.

    Kyle Rittenhouse is a free man today because all of his attackers were the aggressors and because Kyle did everything he could to run away from them until he couldn't run away from them anymore. The McMichaels are convicted of murder today because they were the aggressors and shot an unarmed man 3 times with a 12 guage shotgun. Travis McMichael, in the final seconds, closed to within arm's length of Arbery and then tried to claim that Arbery made it necessary for him to shoot because Arbery grabbed the shotgun. But the only reason Arbery was able to grab the shotgun is because Travis made it possible.

    Sorry, Travis's self defense claim doesn't fly.

    Safety OFF, pull the trigger, BOOM, pump the action, pull the trigger, BOOM, pump the action, pull the trigger, BOOM! Nope, that's not an unfortunate mistake.

    If you're going to shoot another human being, be sure that you are not the aggressor, creating the situation. Be sure it's necessary and legal and that you had no other viable choice. Then you've got a self defense claim.

    Enough with that bullshit. He could have turned around or ran left or right through the vacant land alongside the road. He was not cornered, not one damn bit.

    I see some similarities to the Treyvon Martin - George Zimmerman case. Treyvon attacked Zimmerman after he kept following him.
    As a result, Treyvon was shot and killed.

    In that case, Zimmerman was found not guilty, despite controversy and outcries (though a lot of that outcry may have been manufactured due to deceptive news media coverage).

    Some similarities...except Martin wasn't hit by Zimmerman's car. Zimmerman also didn't try to perform a citizen's arrest or prevent Martin from escaping like these people. If they had followed Arber without attempting to initiate conflict, they probably wouldn't be in prison. Why didn't they call police and follow from behind to keep them updated on his location?

    What the publicly released video. As I said without reasonable grounds to suspect the victim had committed a crime everything they did from the moment they approached him was potentially illegal. Just stepping in front of a person and yelling stop while preventing any further forward progress by that person can technically be considered 'assault' (as opposed to 'battery' which involves physical contact).
