    Judge Doughty said “If the executive branch is allowed to usurp the power of the legislative branch to make laws, two of the three powers conferred by our Constitution would be in the same hands,” Doughty wrote.

    “If human nature and history teach anything, it is that civil liberties face grave risks when governments proclaim indefinite states of emergency.”

    “During a pandemic such as this one, it is even more important to safeguard the separation of powers set forth in our Constitution to avoid erosion of our liberties,” he added.

    Though Doughty acknowledged the Supreme Court would likely ultimately decide on the matter, he also said “it is important to preserve the status quo in this case. The liberty interests of the unvaccinated requires nothing less.”

    In my mind, no emergency is a legitimate excuse to trample on civil rights. Victory indeed. Onward to the SC (probably).

    that's fine, now Covid is on Congress.... Biden did all he could, Judge says this is Congresses problem now

    we always knew it would be blocked eventually, but many got their vaccines, so there is that

    by their employer, they had a choice jabs or tests

    more jabs is a good thing, people on the fence just choose to get them

    most corps will probably continue the course until the SC ways in, the Republican SC will prob drag it's feet for a month

    False. Many employers have anulled the 'test out' option. The city of Seattle is one example. Hospitals by and large are also not accepting frequent tests as an alternative to vaccination. Possibly a reason for this ruling.

    The choice is jabs or get fired. Thats fine if its in the employment contract. It wasn't.

    I am pro choice. It seems you are merely pro abortion, unless you also oppose the coercive mandate of vaccines.

    So we are ruled by fear and fiat confirmed(by strategy, thankfully not by the court.) You know, the same things they accused Trump of doing(but he never did, with the exception of course being January 6th. Which I do think is a disqualifying event.) But even given the 6th, that Biden pulled this stunt is proof that Biden is by far, a worse President than Trump ever was, to use fear and fiat to govern his people.

    And since Democrats approve of the strategy, a 2024 Republican President is necessary to show them not to govern like this ever on a federal level.

    I am pro-choice you decide for yourself, you can choose to have a baby or not, pro-choice, the alternative is anti-choice

    I do oppose vaccine mandates, I think it's good to get the vaccine, but I opposed the mandates

    your body, your choice

    I oppose laws against dr shopping too, your body, your choice - the doctor works for you, he is not supposed to be the prescription police and decide for you, he should educate you, then you decide

    Im just as opposed to restricting abortion as I am mandating vaccination.

    Would you defend an employer requiring all employees to submit weekly pregnancy tests so they could monitor whether anyone had received an abortion or not, and firing them if they did? How about a govt mandate that all employers over 100 employees do this?

    nope, I do not support making insurance cost more for smokers either - do you support insurers making anti-vaxxers pay more for insurance?

    insurers can charge whatever they want, so long as people are not forced to buy it.

    "biden did all he could" ... "but many people got thier vaccinations, so there is that"

    Please explain how your comments here are not a 'ends justify the means' defence of fedgov mandating that employers coerce their employees to violate their body autonomy.

    it means the right can't say Biden did not try, he tried, he was blocked by the courts

    the right can no longer attack Biden for not getting more people to get vaccinated, that is on the people (or congress), not Biden

    I don't think anyone 'on the right' has said that Biden isn't trying to force people to get vaccinated...

    they did early on, when they thought Biden was not going to do it, they were going where is this mandate Biden said he was gonna do..... I was shocked he did it too, I thought was just a bluff

    I do not support the mandate, but I also think the more people that are vaccinated, the better

    it's just not the government's place to decide

    None of them fiats(the low hanging fruit would of course be the 'travel ban'. But as the court litigated, there is no law(rightfully so) that obligates some foreigner to be able to cross the US borders indefinitely! If that's the extent of Trump's fiat(prior to the 6th), I hope we can all agree that's different from mandating we shoot something up our bodies. Even if it's healthy for us, that will naturally be bore out on its own. The right to self determination exists be it for an abortion or for a needle. Our choice, our lives.
