Virginia's Republican attorney general withdraws state from legal push to recognize Equal Rights Amendment ratification
Virginia's Republican attorney general withdraws state from legal push to recognize Equal Rights Amendment ratification (msn.com)
Virginia Republican Attorney General Jason Miyares has withdrawn the state from a lawsuit seeking to compel the federal government to recognize the Commonwealth's 2020 ratification of the Equal Rights Amendment and place the text in the US Constitution, according to the Associated Press.

GOP has a love affair with identity politics and uses that agenda to MAKE THE 19TH CENTURY GREAT AGAIN in order to discriminate against others.

    Martin Niemöller:
First they came for the socialists, and I did not speak out—because I was not a socialist.

Then they came for the trade unionists, and I did not speak out— because I was not a trade unionist.

Then they came for the Jews, and I did not speak out—because I was not a Jew.

Then they came for me—and there was no one left to speak for me.

To update Niemöller's sentiments to the USA in 2022:

The GOP came after voting rights, and ................
Then the GOP came after Muslims, and...............
Then the GOP came after workers' rights, and..........
Then the GOP came after LBGTQ community, and........
Then the GOP came after books, and...........
Then the GOP came after women's rights, and..........
Then the GOP came after the least among us, and.......

It seems with today's GOP, the only ones that matter are rich white straight men who are faux Christians.

Not completely unsurprising as the party is controlled by evangelical men that believe women are inferior to them.

There is no reversal of a constitutional amendment once signed and no time limit either — but we will see how the new stolen fraudulent SCOTUS rules.

It will probably be up to the SCOTUS to decide if a state can rescind ratification.

A total of five states — Nebraska, Tennessee Idaho, Kentucky, and South Dakota — have attempted to rescind their initial ratification of the Equal Rights Amendment. The legality of these recissions is questionable. Article V of the Constitution speaks only to the states’ power to ratify an amendment but not to the power to rescind a ratification. All precedents concerning state rescissions of ratifications indicate that such actions are not valid and that the constitutional amendment process as described in Article V allows only for ratification.

Yes, it is silly for grown adults to support bigotry, as bigotry is presently supported in the GOP.

Not only that but the time ran out on the ERA ratifying process decades ago. If they want to ratify it they have to start over in congress or the convention of the states to pass it again and begin state ratification process.

    Wrong! Here's the original proposal:

    STATUTE-86-Pg1523.pdf (govinfo.gov)

The key phrase that you should review is:

"within seven years from the date of its submission by Congress"

That time period closed on March 22, 1979. Whatever Virginia tried to do in 2020 is irrelevant.

Denying reality is also a trademark of today's GOP, such as the nonsensical rants of the worst president ever, Crooked Donnie Trump, that he didn't lose the 2020 presidential election.

Not very well read on this?

The original deadline was extended (to 1982) the legality of which was never challenged in Court.

In 1978, Congress passed (by simple majorities in each house), and President Carter signed, a joint resolution with the intent of extending the ratification deadline to June 30, 1982. Because no additional state legislatures ratified the ERA between March 22, 1979, and June 30, 1982, the validity of that disputed extension was rendered academic. Since 1978, attempts have been made in Congress to extend or remove the deadline.

In the 2010s, due in part to fourth-wave feminism and the Me Too movement, there was a renewed interest in adoption of the ERA. In 2017, Nevada became the first state to ratify the ERA after the expiration of both deadlines, and Illinois followed in 2018. In 2020, Virginia's General Assembly passed a ratification resolution for the ERA, claiming to bring the number of ratifications to 38. However, experts and advocates have acknowledged legal uncertainty about the consequences of the Virginian ratification, due to expired deadlines and five states' revocations.

It sounds like the SCOTUS will need to settle this

It will probably be up to the SCOTUS to decide if a state can rescind ratification.

A total of five states — Nebraska, Tennessee Idaho, Kentucky, and South Dakota — have attempted to rescind their initial ratification of the Equal Rights Amendment. The legality of these recissions is questionable. Article V of the Constitution speaks only to the states’ power to ratify an amendment but not to the power to rescind a ratification. All precedents concerning state rescissions of ratifications indicate that such actions are not valid and that the constitutional amendment process as described in Article V allows only for ratification.

I'm plenty well-read on it. It doesn't matter whether states can rescind their ratification or not, because the deadline for ratification expired decades ago. Nevada, Illinois, and Virginia were decades too late. That's what matters for purposes of the ERA ratification.

Trump was a far better president than Obama or brandon. Brandon however, is genuinely the worst president we have ever had.

Denying reality, is the trademark of todays Dems.

Whether a state can rescind its ratification has never been adjudicated, but there is little reason to think they can't rescind. Of course once an amendment is ratified by 3/4 of the states there is no changing their minds then.

When the clock was running out on the ERA they added a seven year extension to the ratification process. That clock also ran out. The GOP senate when Reagan was President did not opt to further extend it. It’s dead.

“Article V of the Constitution speaks only to the states' power to ratify an amendment but not to the power to rescind a ratification.”

It is not a power the states have been given per the constitution but I fully expect the unelected against the will of the people stacked conservative SCOTUS to “interpret” it differently.

I think such a ruling makes eminent sense and logic, but predicting court cases is a very nebulous business.

I would if I had the authority to do so. I jus think it's hypocritical that so many Republicans hate everyone that doesn't look, love or worship the way they do and ignore or gloss over the fact that non-Rs are the ones financing their lives.
