On another note please tell us how does affirmative action give us bad lawyers,doctors and nurses, when they have to pass state boards or bar exams??? It seems some people don't understand what affirmative action is. Affirmative Action is this: When two candidates compete for a position, whether it be employment, school or whatever, and those two candidates have equal qualifications, then affirmative action says the person chosen should be from an under-represented group. That is it!!! Now I suppose the other option would be to simply flip a coin -- 50-50. But Affirmative Action does not violate the 14th amendment, especially since in a few decades, Caucasians might be the ones utilizing affirmative action since they will be in the minority. GDAY!!!

Answer: For protected affirmative action people, the passing score for exams is much lower than for caucasians.

You can't always have both diversity and equality. Sometimes you can force diversity by throwing equality out the window, and that's what affirmative action is.
... Maybe the problem you fail to see is the age group of the "court-mandated" hirings. They are older men, whereas the other recruits are young men. Second, they were selected years after applying- meaning that their focus was likely given over to some other job and Firefighting long gone from their minds. You would likely see a different statistic if the FDNY decided to hire younger applicants of these minority groups. Ages more in line with the rest of the non-minority applicants. Is this a fair assessment?
One of the weak spots of the court system is that it can work only with litigants with what lawyers call "standing." The judge ruled in favor of guys passed over before - not younger guys. These specific guys may have exactly the problems Post #19 describes. Similarly a TV show about crab boat fishermen showed a fortysomething Green Beret (one tough hombre) getting eaten up by the physical rigors of life on a crab boat, but 18 year olds adapt. Maybe an retired Coastie or a destroyerman from the USN could have done better. They are totally adapted to the motion of vessels in rough water and have no issues with seasickness. But if the judge found for younger men would that not be age discrimination? Maybe some of the guys jammed down the FDNY's throats are simply too old, but I suspect some of the washouts never could have done the job even at a younger age.

You've obviously never worked in an HR dept or seen AA in action. It is NOT that simple. Not by a long shot. Lets just say, you get extra points for being a minority. Being equally qualified is rarely the case. If everyone was equally qualified, there wouldn't be an underrepresented, because they would have the jobs. Its an outdated concept and legal racism.

How about they make a rule where they fire a white person who has a lower "score" and allow the new white applicant to take his place??? This should fix it, no???
