    Odd how even though a majority in your "religious" poll view it as immoral they favor marriage equality. Shows how some people understand how their religious beliefs cannot infringe on the freedom and equal treatment of others. Good for them

    Not quite? Seriously? This Overton window theory is quite interesting but it does not, in any way negate the reality of constitutional law that I pointed out here. Sure, the court is not operating in a vacuum and they are very much sensitive to public sentiment. Al the more reason that I believe the ruling will be for marriage equality. It does indeed appear that the stars are in the right alignment. As evidence, there have been dozens of friend of the court briefs filed on behalf of gay marriage buy business and religious groups, and even by prominent Republicans. It would appear that there is in fact broad support, and that many have decided that gays are not a threat and in fact good for business and good for the country. Conservatives have even made a conservative argument for gay marriage because removing the bans is constant with small government,

    Brilliant! Just Brilliant!! The churches. So then only Christians can be married? Seriously. You want to institutionalize religious discrimination? Government regulation of marriage is a tradition brought from England to the colonies. It is here to stay. Same sex marriage is an equal protection under the law issue. It's that simple

    I agree marriage should be privatized, prohibiting the government at any level to define what marriage is or is not. This also essentially prohibit religions or churches from acting through the state, to deny marriage to certain groups.

    While there are some bugs in Privatizing Marriage, such obstacles are easily surmounted and we have a win-win scenario.

    Your claim was that public sentiment is irrelevant, because the constitution is constant and rights are rights. I would say that you are right about the reasoning but (as we seem to agree) the timing also matters. The decision to eliminate the bans and let people marry clearly SHOULD have been obvious over 100 years ago, yet such a decision at that time would have been unthinkable - and if it were made, it surely would have caused enough backlash to lead to a constitutional amendment overruling the decision! Today, while the constitution hasn't changed, public sentiment very much has, and that enables a decision that was legally correct but politically impossible before.

    The Overton Window doesn't negate the law, it explains why the law could not be properly applied until recently.

    Yes, I've read up on the topic and am familiar with the pro's and con's of such an initiative. Even before religion, marriage is a "business contract." and a source of tax revenue which dates back to the "Code of Hammurabi". A marriage under contract also benefits couples. Marriage is so ingrained in business law, as it involves property, social obligations and wealth, it has its own judicial setting; Divorce Court.

    The right for a US citizen to marry any person they choose has already been defended or addressed in 14 different Supreme Court Cases: Marriage is a Fundamental Right. I've read the oppositions rationale (mainly conservative) behind "privatized marriage" and found it to be an irrational dichotomy. They want government out of the marriage business and at the same time, want to pass laws that prohibit gay marriage. They can't have it both ways.

    You will take any poll that says what you want ....

    What marriage equal rights? Gays want an exception made for them....not equality.

    And clearly, so will you. Even if his poll addresses the topic directly, and yours asks a different question.

    And the "exception" is to be permitted to do what everyone else can do. How wonderfully Orwellian - bans are permissions, inequality equals equality, special prohibitions aren't special or prohibitions. Proving once again that there is no sensible limit to what the human mind is capable of believing, against any amount of contrary evidence.

    OK, than we agree that the time is now right for marriage equality. When I said that public sentiment is irrelevant, I meant strictly from a legal viewpoint. Of course it does influence judges and lawmakers

    What I have so eloquently shown is that polls are available to show whatever results one would want...just like studies and research.

    Gays want special laws that only pertain to them. What a spoiled bunch.

    What you showed is that if you ask a different question of a different group of people, you get a different answer. For you, it doesn't matter WHAT you ask or WHO you ask, it only matters that you can misrepresent the results in support of a lost cause. Really rather pathetic.

    Marriage is not a Christian thing. Marriage is recognized in nearly all religions.

    And there are churches that recognized marriage...

    Marriage has been around for thousands of years and it didn't originate in England.

    If government didn't regulate marriage, there would be no equal protection under the law issue.

    Why does the government need to know if I'm married? They don't!

    State/Federal governments don't need to know if you are married. If two people want to create a legal binding contract (for financial, medical, or children reasons), then they can go through the private sector and legal system to do so.

    Why does the left want the government to control every aspect of their lives from cradle to grave???

    the real question is not whether SCOTUS will affirm this due process claim to equality. It will. there is no question that same sex marriage is gaining substantial support in blue states and urban areas in red states. The question is just how will gays who marry be treated in the deep south, in Texas and in the less populous rural counties after they have those licenses. What happens on their walk to their car, and into their appartment, and to the grocery store? Will those good Christian folk down there participate in beatings, broken windows, vandalism and harrassment, or turn a blind eye to such? Will local police and sheriffs investigate or will the police reports be buried? Will the DA's office aggressively prosecute and will there ever be any witnesses found who want to testify? Will there be one rule of law applied all perpetrators of violence, or will there be two different sets?

    Is this going to be another case where systemic brutality or cruelty is rationalized and tacitly endorsed by the majority because the uppity minority 'ask for it'?

    Why does the right wing always think that everything that government does is bad. I am married and the government does NOT control my life. That is absurd. The legal marriage is there in the background and it provides a level of security for me and my family. The gov. provides a lot of benefits and protections and that's why they need to know who is married. I don't see see what the problem is. To avoid gov. recognition of same sex marriage? Did you by any chance read post #30 above?

    Another selfish person who seeing the right that was exclusive being applied to others wanting to jut the legal support for it. It is like the guy who kills the girl who breaks up with him so she can't date anyone else.

    Nope it's not an exception for them. When SSM is leagalized YOU also can marry someone of the same sex.

    Equal rights is not special rights. This "special rights" thing comes from the libertarian/conservative camp opposed to gay rights. It's all moot at this point anyways. Come April 28th, the justices will start hearing the case and render their decision soon afterwards.
