White House planning to proceed with State of the Union, but details up in the air after Pelosi thre

    In the good old days they wrote them and submitted them to Congress. He can still do that. But he won't.

    You are not getting this. The constitutional duty exists to inform Congress of the state of the union from time to time. that's it. There is no proscribed constitutional duty to appear on the House floor. There is no proscribed constitutional duty to speak to Congress at all let alone in a gathering. There is no proscribed constitutional duty to do any of this 'informing' in January. There is no proscribed duty to do this every year. Stop declaring there exists all these duties without any evidence. Every single President elected after John Adams ( number 2) through to William Howard Taft ( number 27) clearly disagreed with your interpretation. they all wrote an essay describing the state of the Union and submitted that paper to Congress - in writing. None of them gave a speech to congress.

    That is not part of the 'duty'. It is a privilege the House or Senate extends to the President by invitation. This President can either submit his little essay to the House and Senate, thus fulfilling his constitutional duty, or he can damn well wait to be invited to speak and fulfill it then. .

    Trump has a friendly venue at the Senate. Democrats are allowed per the Senate Leaders permission.

    The problem is space. That chamber is smaller. it won't fit all the senators, the House, SCOTUS, the pentagon brass, the cabinet officers, invited guests etc. I think he may have to do it outdoors, like an inaugural address but who knows who will show up, or how the media will cover it?

    I practice in Georgia myself. I have a question that I'd like to run by another attorney. I believe I am correct, but it isn't a point that I have seen echoed in any of the articles.

    Would Trump be able to limit the audience based on their political affiliation when he delivered the State of the Union (assuming he delivered it at a place like a concert hall, or wherever he usually holds his rallies)?

    So I know that the first amendment limits the ability of the government from excluding individuals from public events for reasons like race, sex, or political affiliation. Trump can and usually does that at his campaign rallies because they are not public government events, they are private political rallies. Is Trump delivering the State of the Union enough to make the event a government event for the public? Would the answer change if he previously delivers a written version of the speech to Congress and thereby satisfies the constitutional requirement of delivering the State of the Union to Congress?

    This surprises me. I thought he structure an outdoors event and go for a second inaugural -like feel to the address in the hopes it would feel more official..

    There wouldn't be in Congress either. At least giving the speech from the oval office he won't have the Democrats sitting with arms folded glowering for the cameras.....and he can excoriate the Democrats on National TV for wasting $2.6 billion a year on just beds for detainees crossing the border, not including health care, food and legal fees.
