A black woman was beaten by a white man with a gun. Police charged her with damaging his truck.

    Now here is an interesting case.

    A man slaps a woman's cellphone out of her hand, she slaps him and he strikes her 4 or 5 times with a handgun.

    After the altercation she smashes the windows in his truck and at first she is the only person charged in this case. After folks protested and called for Justice the man is charged with a crime.

    How should a case like this be handled?

    Would need more context. If he had not knocked the phone out of her hand, I would have sided with him she since she struck the first blow. The fact that he first intentionally knocked the phone out of her hand could plausibly characterized as a physical assault but if that is true perhaps the breaking of his windows could be characterized as a physical attack. Got give to her, she can take a punch. **** like this goes down every day, hell I was involved in instances like this when I was young. This is certainly not worthy of the coverage it is getting.

    In Texas last month, a black man robbed a white clerk, tied her up, doused her in lighter fluid and then started her on fire. It was a gruesome act that attracted little media/twitter attention.

    Really, I don't see men hitting women with pistols on a daily basis.

    Was he charged?

    Her charges were dropped.

    Two enormously stupid people, one violently so.

    Both contributed, but he needs to do jail time.

    She should pay for his windshield, or it can come out of whatever civil judgment she gets if she sues him.

    Of course the guy was charged. Regarding the case you are referring to, as I said, I could either way on it and would need more information.

    I took beating a hell of lot worse than that when I was young. Never had the pleasure of knocking somebody out although two of my brothers did. My old brother took out a classmate who he caught window peeping on our mom (totally vicious) and my younger brother took out a guy at a Brewer game in an epic one hit knockout. One of the best fights I ever saw was at SummerFest where a skinny guy around 5'10 took out two 6'3" body builders. He completely brutalized them. The best fight I ever had was when I was in 8th grade and took out a 10th grader who was molesting one of my younger brothers. I wrestled/boxed alot in my youth and the guy was a pansy. I wrestled him down and pinned his arms so he couldn't defend himself and then went to town. He started screaming and it scared the hell out of me so I jumped up and ran away. The worst fight I had was in a bar over one of the hottest girls I ever dated, I lost and lost her too. Probably for the better, any woman who would pit two men in conflict over her would make for a piss poor wife.

    So a man knocking a woman's cellphone out of her hand and beating her with a pistol is equal to her punching him which in my mind was self defense.

    She probably did not handle herself well in front of police.

    If police arrive to settle a physical dispute and there is one who is calm and the other one is crazy and in your face, they'll arrest the crazy.

    There's too much information missing or being withheld from this story. Supposedly she's calling "911" because she's concerned about her safety, but then she slaps the guy who's holding a gun. Is that a reasonable response?

    It was a really stupid response.

    Why aren't there laws against being stupid ?

    Silly question, considering it's Texas, haha.

    Based on the articles I've read, he claimed he drew the gun in self defense after she physically threatened him with a mace. My guess is she was still threatening him when he knocked the phone out of her hand and she wasn't actually dialing 911.

    They both committed crimes. They should each be charged with the crimes they committed. I think she got a little black privilege from the DA.

    This is what I've gathered from listening to local radio and reading local news stories. It's not gospel, as some of it is heresay.

    She drove the wrong way on a one way street and parked in front of the exit of a parking garage, blocking the guy's way out after getting off of work as a bartender.

    He confronted her. I don't know how he approached her. An argument ensued.

    She threatened to use pepper spray on him and he brandished a gun.

    She said she was going to call 911 and he knocked the phone out of her hand.

    She hit him.

    He hit her 5 times with everything he had and then kicked her phone.

    Sometime after that, she got up and did damage to his car in retaliation.

    The police arrived and he was drunk and she may have been. I'm not sure.

    He is looking at aggravated assault, illegal possession of a gun(brandishing and while drunk), and maybe interfering with a 911 call.

    She was looking at a felony for damaging his property, which she admitted to, but her charges were dropped.
