    HOAs have to do with mostly limitations of liberty. One could say if you don't like your neighbors just move. If your upside down $150,000 mortgage and your neighbors moved in there after you and decided to start a landfill in their backyard your liberties are limited. You can't sell your house, you'd lose too much money. So you can't move.

    It goes on that principle vet your right to swing your fist ends at my nose. So you're right to do anything you want with your property inns at the ability of me to sell my property for what it's worth.

    Even if he is a Nazi Party member, his property, his choice. I'd rather those kind of people reveal themselves anyway.

    How would you feel about living next door? If the guy was an ass you just move right? Who's going to buy your house? Who wants to live next to giant swastika man? It's probably a much narrower market, so the value of your property will be extremely limited. And if you're upside down in $850,000 mortgage, you might not even be able to walk away.

    If you moved in before giant swastika man, none of this was your choice.

    So yes it may be his property, but his property in the things he does on it affects your life.

    This is why when I fly my stars and bars while grilling burgers and drinking Milwaukee's Best, I make sure I use the small flag that about 2 inches by 2 inches and only sits on a one foot pole.

    Yes, that’s correct, and if he lives in an HOA then they have the ability to start foreclosure proceedings over it.

    What if he decided not to throw out his trash and just pile it up in his backyard?

    Would that bother you? The smell the rats the bugs?

    If you're willing to limit someone's right to keep trash in their backyard then what is the threshold?

    I'm not sure I understand your question.

    Someone can have a garden displaying a political symbol without that rising to the level of a private or public nuisance claim, despite the fact that their neighbor peaking over or through their fence into and gazing into the property finds the display horrendously offensive so much so that they are "literally shaking".

    I'm not sure what you mean by inoffensive voter is enough. What in the Green Hills of Earth are you talking about?

    it does cause real harm and damage it lowers the value for the properties around it.

    If the force the community uses against that guy is born out of an HOA agreement that he signed into, then that is not quite that same thing as losing your 1A rights due to a depreciation of property value alone, is it.

Yes an ODOR that is so foul as to permeate the property lines and dwellings of others so much so as to ruin their quiet enjoyment of the property (quiet enjoyment being a term of art and not a layman's term.     You could certainly argue that in a court of law. And I agree that damage or harm could be construed, I remain unconvinced he should lose his 1A however.
