Community is up in arms after neighbor installs giant swastika in front yard

    How is it not hypocritical to ban offensive orders and sounds but not sights. I can't store all my trash in my backyard, and I can't play death metal at a certain level of sound all night.

    Even if I like the way it looks I can't engine blocks laying all over my yard. Even if I consider it art.

    So why is it a special consideration for if I paint a swastika on my driveway?


    in this picture it doesn't look like something in the backyard so you are moving the goalposts.
    I'm going to say it's a typo please do don't tell me it's not a typo when I say typo I mean error in typing. Spell check attempted to correct it it did so improperly.

    I did correct that post because I saw what I had typed, but I was trying to say an offencive odor.

    City can step in and act as well. No different from trash in your yard or unreasonably tall grass.

    You don't have that much of the outfit and not be in a club of some kind. Should be easy to tell if he rides with a racist club.

    what if I do not have to peer into their yard to see it? What if in order not to see it I have to avert my gaze?

    I do not click on links. if something from it was important you would copy and paste it here like the Op did.

    I think it is different though. He's espousing his beliefs in a manner not endangering public health like trash would. People are just mad.

    Property taxes are determined by the sale of comparable homes in your area. Not your home’s value as impacted by immediate surroundings. You’d have to file a protest of your home’s assessed value, which have historically low success rates.

    Because the smell follows you inside as does the noise and vibration. The sight is only visible if you happen to be snooping IE gazing into the property of someone else. If it were something OTHER than a quiet display behind the property line you almost have to be in a vertical position to notice the shape of, like say a GIANT FLASHING DISPLAY OF A SEX ACT or something like that? Different story. Giant movie projector screen? Counts.
    But a bench/garden in his yard that you have to use a drone to understand is a swastika? That doesn't rise to the same level.
    Watch an old cartoon where the character is trying to sleep and someone keeps disturbing them. Its noise. A smell. Bright flashing lights. Something intrusive that ruins their ability to sit and be inside the dwelling.

    What special consideration? What are you talking about?

    You are likely citing numerous public ordinances and/or HOA covenants disallowing TRASH on the lawn. If you'd like to represent that the blocks are art, as an attorney I'd suggest you organize them into some sort of purposeful display and maybe add paint or signage or something indicating it is art and try your luck. It will likely be sufficient to get you past the "trash" category. Give it a shot. Likely won't get you past your HOA though as they likely have a clause about displays.


    I didn't say the back yard. I said the YARD. As in the land not covered by the improvements which surrounds same. The land on the private side of the property line. You're staring in. Stop doing that, or get off the vertical axis, and the display disappears with only your knowledge to burden you so. No smell. No noise. No intrusion from their property on to yours. I'm not moving the goal posts, but you feel free to be completely wrong. You're certainly doing a bang up job of it so far.

    I think you might want to look at the pics at the beginning of the thread. It seems to me the "design" is designed to be viewed.

    No one should be able to see my tiny tiny stars and bars and toy cannon in my backyard though. Tradition not hate. (-:

    There does not need to be general neighborhood rules and decency

    Individual standards on private property prevail.

    In addition this sort of thing needs to be more common for the simple reason of challenging the progressive left which is attempting to stamp out freedom of speech

    Typically HOAs have become more popular in areas where a lot of lower income people, especially people from other cultures with different aesthetic values, are moving in.

    When problems are created, everyone has to deal with annoying rules to deal with those problems.

    I've seen the pics, thanks. Unlike some complete and total wastes of oxygen who shall remain nameless, I read OPs and read links as well.

    If you have to see it from the air to view the design, I'm pretty sure its just for him and other people are being nosy.
    Not to mention: Simply having a design that can be seen and causes someone offense does not constitute nuisance legally speaking.

    I'm not saying he should lose his first amendment I'm seeing there's limits to liberty. I have the right to have a gun I don't have the right to walk around waving it around at everyone.

    I agree that ethos of the far right means never inviting them over for a block barbeque.

    However, I think the guy has the right to do it on his own property
