Can President Trump Lawfully Ignore Election Results To Stay In Power?

President Trump will lawfully ignore election results to stay in power because he is Commander in Chief of all standing armies and militias in America, and has ordered Republicans to 'stand back and stand by'.

The election results were different than the Gore election because this time they were wrong in biblical proportions, and not just the State of Florida.

Since a President pragmatically cannot be determined in less than 2 months by the courts, President Trump can simply refuse to concede to remain in power come January for a second term.

Not possible since the military will follow the president who is Biden. The election will be decided by Jan. 20 whether the courts do it or congress does.

 

Trump will see his fraud case through and if that fails then he is done. Trump has never given anyone a reason to believe he would not give up power except if there was fraud thus his investigation.

Anyone that thinks Trump will go kicking and screaming is not being realistic.

Now the speaker of the House can in some cases decide but this won't be one of them. The only other path for Trump if his case of fraud fails is to keep states from certifying results thus the state legislators who are majority Republican would have to vote and Trump would win that vote but it's a very long shot. Not likely to happen but not impossible.

If he wins his fraud case with the Supreme Court he can still win.

Biden may win but that would be the only big win for Democrats considering they failed to take the Senate and lost many house seats. The Senate run off races will most likely go to the Republicans considering they both had majority of votes the first time around.

 

There is no law that compulses concession. But if the state Electors certify Biden with 270, Biden is President and Trump is not.

But Biden is not President until they do.

 

If still there, on Jan 20th trump will be trespassing.

 

Biden officially becomes President-elect when electors vote on Dec 14. There is no requirement for Trump to concede. Failure to concede will just be one last chance to make an ass of himself.

It seems like I'm the only one to know what Trump's militia comments actually means. When he said "stand back" he meant not to engage, or be a part of, the protesting and rioting in the USA. But to step away from it. When he said "stand by" he meant lower the level of alert and don't engage in a hot war with the other side.

 

Wrong. Trump has a legal team investigating fraud. Why do you keep saying this is false? Are you afraid of what may come out? Rudy Guiliani publicly stated they have enough evidence to over turn the election. They just can't release it yet is what he said.

The only problem with your statement is that Trump is convinced there was fraud, and no evidence to the contrary will ever persuade him to believe there wasn't. His proof: he lost, and he prophesized he could only lose if there was fraud. Still, I agree he will give up power - he'll have no choice about that.

The Constitution specifies when Trump's administration ends. Using the military to quash the Constitution in this regard would be (and I never use this term lightly) fascism. According to the Constitution, even if there were no winner declared by then (and there will be), Trump's Presidency would still end. It would got to Pelosi in the meantime.

 

I don't think "fascism" is the right term. I'd use "treason". The sad thing is that many Trump loyalists claim to be ultra-patriotic, but push to ignore the law in order to keep Trump in office (e.g. Mark Levin).

An acquaintance of mine (here in Texas) made a facebook post in which he was pushing for Texas to secede. In his next post, he related that he'd served in the military and still feels bound by his military oath to "support and defend the Constitution of the United States against all enemies, foreign and domestic". The funny thing about this is that the "domestic enemy" terms were added during the Civil War, and were referring to secessionists.
