No, Trump Isn’t Guilty of Incitement

    House Democrats have drafted an article of impeachment that accuses President Trump of “incitement to insurrection.” Acting U.S. Attorney Michael Sherwin said Thursday that his office is “looking at all actors here and anyone that had a role” in the Capitol riot. Some reporters have construed that as including Mr. Trump.

    The president didn’t commit incitement or any other crime. I should know. As a Washington prosecutor I earned the nickname “protester prosecutor” from the antiwar group CodePink. In one trial, I convicted 31 protesters who disrupted congressional traffic by obstructing the Capitol Crypt. In another, I convicted a CodePink activist who smeared her hands with fake blood, charged at then-Secretary of State Condoleezza Rice in a House hearing room, and incited the audience to seize the secretary of state physically. In other cases, I dropped charges when the facts fell short of the legal standard for incitement. One such defendant was the antiwar activist Cindy Sheehan.

    Hostile journalists and lawmakers have suggested Mr. Trump incited the riot when he told a rally that Republicans need to “fight much harder.” Mr. Trump suggested the crowd walk to the Capitol: “We’re going to cheer on brave senators and congressmen and -women, and we’re probably not going to be cheering so much for some of them. Because you’ll never take back our country with weakness. You have to show strength and you have to be strong.”

    Now, I'm gonna be blunt, cynical, and very politically incorrect, so those who feel they may need a safe-room, please depart for one now.

    There was no incitement to riot, to be violent, to take arms or to storm the Capital. This here is no brainer, and no rocket science. So, what's going on?

    A Capital cop along with several other people was killed. It's a terrible thing for sure, and cops die in the line of duty all the time, but this one is different. How?

    TRUMP!!! Let's not let a good crisis go to waste, and the Democrats waste no time. The dead cop has been hoisted on the pedestal as a martyr, and President Trump is being blamed for his death as if it was he who has pulled the trigger. The whole thing, as terrible as it was, is being billed by the Democrats as an insurrection, treason, sedition and whatever other scary words the Democrats are able to find, and the dead cop is now a symbol of it.

    The Democrats are masters of not wasting a good crisis. The riots, the fires, the violence, the storming of Federal buildings have raged through the summer with not much as a squick from the Democrats, who even supported the rioters and vandals by posting their bail! But now with Trump supporters storming the Capitol and it's getting out of hand, what a beautiful opportunity, let's not waste it. Let's impeach Trump again, let's deny him his public platform, let's cut his financial support, let's do all these unconstitutional things under the pretense of Trump instigating violence!

    Democrats are anything but predictable.

    This is all spin on the Trump haters part. Perhaps if democrats didn't steal elections things would be better.

    perhaps if trump and his supporters didn't lie about democrats stealing elections, trump wouldn't have to incite riots to try and overturn a free and fair election.

    I was just making the same baseless argument he made. I don't think trump incited the riots. He fueled the fire, no doubt, but he didn't reach "incitement" level.

    There was of course no election fraud or democrats stealing of elections. Which was my point with my post to doombug

    The legal asis that form what is excitement says that the language can be direct but " more often the inciter's language will be ambiguous. can be "indirect". The verbs of incitement are induce, encourage , inspire, abet, arouse. The use of ambiguous language by Trump who most often orb usually is ambiguous. Ambiguity in language an save the person being sued if the ambiguity is in the performance section of the contract. Yet in the criminal sphere ambiguity in language used can and hopefully in this case snare those with evil intent.

    Trumpers were wrong on 60+ lawsuits and SCOTUS despite having mountains of evidence.

    They don't exactly have a convincing track record.
