    I suppose one fact could be that once a sitting President is no longer in office, he/she may be prosecuted for crimes committed while in office, as long as the crime is within the statute of limitations.

    I believe Mueller noted in his testimony to Congress that the federal statute on limitations for obstruction of justice was five years, from the time the crime was committed...that would cover Trump's term of office + 1 year. Presumably, he has other court cases pending...on campaign finance violations (the pay-off of Stormy Daniels and the former Playboy model), possible tax and bank fraud, and the Mueller obstruction charges, plus various charges related to his first impeachment, over Ukraine, and the more recent January 6th attack on the Capitol. A mix of local, state, and federal charges.

    What in the world could they possibly have that would lead to a criminal conviction? Because it isn't what we have seen so far.

    One could argue a tort was committed, but can you even go after a president for that?

    Damn right!

    The Republicans have been demonizing Democrats for the past 12 years. The proof is all over the place including here on this forum. Democrats need to be as cutthroat as the Republicans because the GOP has gone off the rails! They are the ones who believe that a president is above the law, but you are right, the Republicans will most likely refuse to convict not based on evidence, but fealty and fear. IMO, such cowardice needs to be exposed, not dismissed because they refuse to do the right thing. It may be political theater, but one that we must do if we are to continue to be a nation under the law.

    The trial is pre-determined. 95-98 senators know exactly how they'll vote before one shard of evidence is presented. It's nothing more than a political show trial. Yes, the democrats are biased as all get out with the advantage of having a very partisan anti Trump judge presiding in Pat Leahy. How many prosecutors would love having the judge in their back pocket before any trial?

    Trump will be acquitted somewhere between 50-50 to 55-45. I'm not going to watch a single minute of it. The trial accomplishes nothing. You can't remove someone already removed. most of the jurors have their made up, nothing fair about the trial.

    what I look forward to is seeing if somewhere along the line the evidence of sedition and inciting an insurrection is presented to a federal grand jury. If that happens, now that would be interesting. A pre-determined show trial in the senate, ho hum, yawn. Just another bit of evidence to show how polarized, divided and how much we have mega, ultra partisanship in Washington these days. I know that already also, I need no political show trial to prove that.

    In his Ellipse speech, he shifted the blame for his election loss onto Pence, claiming that Pence had the power to reject the certifications about to be counted, in a joint session, that would be overseen by Pence, in the Capitol, beginning in a few minutes. He also asked the angry crowd, to march on the Capitol, and told the crowd that he would lead them. The mob went to the Capitol and almost immediately began attacking the police and barricades that had been placed there. The lack of preparation by the Capitol Police may well have been in anticipation that the President would follow the Park Service Rally Application. No march on the Capitol was included. The President was the only person who called for the Capitol march.

    This was timed to coincide with the joint session occurring inside the building. The President's speech ended at 1:11 PM. At approximately, 2:15 PM, when it became apparent that Pence was NOT going to reject the certifications (following the Cruz motion on Arizona), Trump tweeted that Pence had failed them. Minutes later, the mob broke into the Capitol, in an effort to shut down the count.

    IMO, the President called upon the mob witnessing his Ellipse speech to march on the Capitol to support Pence in a potential refusal by him to complete the count or to reject the certifications of the six contested states. That would be a violation of Title 18 U.S. Code Paragraph 2384, "Seditious Conspiracy" and the charges of the House impeachment resolution, under Article I, "Incitement of Insurrection."

    The "Seditious Conspiracy" law reads: "If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, OR BY FORCE TO PREVENT, HINDER, OR DELAY THE EXECUTION OF ANY LAW OF THE UNITED STATES, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall be fined under this title or imprisoned not more than twenty years, or both."

    So calling for peaceful and patriotic protest is inciting a riot? Where is the same outrage for Mad Maxine and Kamelass Hass doing much worse? The hypocrisy from the DCP never ceases to amaze me.

    That was only his CYA statement and "conviction" would, admittedly require more evidence. I believe that evidence will be found. As for Waters and Harris, you'll have to quote what you feel was the equivalent.

    One question I would ask Trump under oath would be: "Why didn't you lead the march, as you said you would?" Another would be, "did you see what was going on at the Capitol?" "Why didn't you take immediate action to reinforce the Capitol and D.C. Police with the National Guard?
