Army officer sues Virginia police over violent traffic stop

    He explained that part. He was frightened that, if he reached back in for his seatbelt release, that the screaming policemen with the gun might shoot him. He did try to explain that fear to the policemen.

    Perhaps you could explain how someone can cooperate to the following commands?
    "Keep your hands outside the window, get out of the car, keep your hands outside the window, get out of the car, keep your hands outside the window, get out of the car". Meanwhile you're still buckled in your seat belt

    The barrier was caused by the cop because he refused to tell the guy why he had been stopped. That raised everybody's anxiety. Then, he was told to keep his hands up. He was wearing a seatbelt so it was impossible for him to unlatch it or open the door with his arms up. He was afraid for his hands not to be in plain sight because he had NO idea why he was stopped and didn't want to risk being shot if he the officer thought he might be going for a weapon.

    The officer could have easily defused the situation by being reasonable. He went way out of bounds. There are many good cops out there. Unfortunately there are some that aren't so good.

    Have you heard of the old adage regarding the police of "What can I do to make you more comfortable Officer?"

    It's the same for the military.

    You don't want to make a cop uncomfortable and you don't tend to want to make someone in the military uncomfortable either. The whole "fight or flight" thing is wired a little differently in the brains of those two professions and they tend to understand that pretty well regarding one another. As the person in the position of authority in this particular scenario the onus is on the cop to calm this down. The LT is uncomfortable because he is confused, make him comfortable by answering his question as to why. That wasn't an unreasonable request by any means and by doing so would have diffused all of the tension immediately.

    They’re the very same natural rights inherent in every citizen that you claim don’t exist and aren’t written in the Constitution/Bill of Rights:

    Through that entire thread you made the mistake of denying that all powers/rights are inherent in and possessed by the individual and that any and all powers/rights possessed by the government are derived from the individual and association of individuals we call “the People” and conferred to government.

    In your early 12th Century fantasy land, or communist authoritarian country of your desire, Lt. Nazario has no rights but the rights the government grants him (as if those rights were privileges), and if the government doesn’t protect those rights, as was the case during the incident in Windsor, Lt. Nazario has no rights, much less some Bill of Rights containing a Fourth Amendment where those rights are expressed in writing to remind the government that derives all of its powers/rights from the citizens of this country what rights the government is obligated to respect - whether it chooses to respect and uphold those rights or chooses to violate them and deprive a citizen of those rights.

    As I repeatedly told you before, you are wrong. The rights both exist and REMAIN.

    Lt. Nazario’s rights didn’t magically disappear in the absence of the government’s defense of his inherent natural and constitutional rights or Lt. Nazario’s inability to defend those rights himself.

    The rights continued to exist and remain.

    It’s ironic and entertaining to find you accusing others of wanting to live in a communist authoritarian country when, as you were told by myself and others, you have supported the same position that every dictatorial government, including the communist authoritarian variety, has supported - that we have no inherent individual subjective natural rights. The only rights we have are the rights that the government arbitrarily decides to grant us, like scraps someone tosses to a dog from his table.

    I'm glad he filed suit. The evidence will be presented and weighted and the Court will render a decision that will be both informative and binding. This is how we police the police. The evidence is presented to a jury of folks from the community and they render a decision. It does not appear to me that the police had probable cause to pull him over and one officer validated the fear that the driver verbalized.

    In this case: guilty of being black and so prone to racial bias of unreasonable assaults by cops who got no reason to arrest you in the first place.

    And the cops indeed had no reason to arrest, but did brutally assaulted a black officer, threatened to kill him, and illegally detained him.... fulfilling the stereotype of how cops behave against black people.

    The only rights that exist are the rights man created for themselves. In the US, we decided we won’t permit anyone to search our person or property without probable cause. We decided we won’t permit anyone to detain us without probable cause. This is codified into law, and protected by force. Those are the only rights that exist. Rights that are protected by force. As you are perfectly aware.

    Do you think that the proper response when the police pull you over and you don't think you have done anything wrong is to refuse their lawful orders, to argue with them? And if you continue to do so and when one grabs your arm to get you out of the car the proper response is to jerk it back. You really think that is going to deescalate their response. All the guy had to do was comply with their instructions to him and once they were sure no one else was in the car pointing a weapon at them from inside that blackout SUV, he could have shown the the bill of sale and how it matched the temp tag, that was behind those blacked out windows. And be on his way. OH the officers may have asked him to and even assisted him in putting the tag in it's proper place on the bumper where it could be seen.

    Yea they could have TASED him for his non-compliance but the pepper spray worked. And I don't think they wanted to handcuff him but since they could not see into the vehicle make sure they were safe standing there and no one else was in the SUV. I do not have my vehicles blacked out so you can't see into them do you? I have no reason to believe had he simply got out of the vehicle they would have asked for the bill of sale he should be carrying, affirm he owned the vehicle and he would have been on his way. I don't know what he expected to happen other than they were going to ramp it up on him regardless of his "I'm military you should bother me". They weren't just going to say OH OK you don't want to show your ID and the papers on the car fine go on and drive away.

    As I have said go ahead and do as this guy did the next time the police pull you over, me I will follow their lawful instructions and then be on my law abiding way.

    The same thing would have happened. They would have approached his blacked out SUV with perhaps less concern since he stopped immediately but they would have made sure they were protecting themselves until they could inspect the inside of the vehicle and who was in it and what they were doing. They would have instructed the driver to exit the vehicle. Then there would be two courses of actions either the person does it and the matter of the registration that was in question could be cleared up rather quickly or they could refuse and then force would be used.

    Which course would you chosen?

    The same thing would have happened, since these 2 cops are just 2 thugs who violate the law.


    The initial idea was that the car had no rear license plate. It was behind the rear window, that both were able to spot with ease when walking by. And if they told the army officer what the problem was, he could have replied to it, and that would have been the legal end of it. This is was cops do, not thugs with badges. To demand he had to get out of his car, to be detained... is simply illegal since there were no grounds.


    And so it seems you respect the job security of thugs with badges more than you respect the constitution.

    Always drive to a well lit area with lots of witnesses when being pulled over. It's common sense 101 really but this cop took it as a threat I suppose.

    You're not understanding what I'm saying. I'm not saying it's right to refuse to obey the orders of the cops when they pull you over. I'm saying that's wrong. I'm saying it's MORE wrong for the cops to not tell you why they've pulled you over when you ask them, especially if you are an Army Officer in uniform. All the guy had to do was comply with their instructions, yes. All the cops had to do was tell him why they pulled him over like he asked as well. Either one of those two things would have diffused the situation immediately and neither one of them did it.

    You don't make the cops uncomfortable, you don't make the military uncomfortable EITHER. That's the thing here.

    Cop brain: Why isn't he complying with my instructions? That's not normal, that's uncomfortable. Uncomfortable = Danger!
    Soldier brain: Why isn't he answering my simple question? That's not normal, that's uncomfortable. Uncomfortable = Danger!

    In this particular scenario how do we get comfortable which = "out of danger"

    Cop: By complying with my instructions
    Soldier: By answering my questions.

    See the problem here?

    Who is in the position of authority in this situation which means who's onus is it to make us both comfortable which = out of danger. The Cop. How does he do that? Answer my question. Answering the LT's question would have made him comfortable (out of danger) at which point he would comply with the Police Officers instructions which would have made him comfortable (out of danger). The person who is in the position of authority is the one who is responsible for initiating that exchange. ESPECIALLY in a situation where the two people involved both have brains that tend to kick into rapid fire "danger! threat! fight!" mode REAL quick.

    There are witnesses at the gas station. If he pulled into an alley, who knows what accident might have happened. The cop knows he f'd up since he offered the lieutenant a quid pro quo. The cop got fired but now he can just work in the next county over.

    Very true. Everywhere else I drive about 9 mph above the speed limit (and sometimes I risk a bit more if my Waze app shows no police around). In Virginia I drive at the speed limit (which is boring, but the speed traps in Virginia are all over the place). Going from NC to VA, it's impressive to see how everybody who is in the know suddenly drops to the speed limit when they cross the border. The fools who don't know of this reputation and keep going 9 above or more, we see them a few miles up, stopped by police.
