    She doesn't need any public sentiment to proceed. And you might want to read this. There's a lot of wrongdoing here. The only question is who is responsible for the wrongdoing. The Trumps signed their names to the wrongdoing, so they can be held liable, but the extent of their liability is not yet known. And how is Cohen going to get a retroactively reduced sentence? He's already been sentenced.

    Lol, you don't have to be an expert to see he was doomed to fail in that case. All you had to do was read the court documents and listen to Trump's own testimony. And Trump is notorious for ignoring experts when he doesn't like what they have to say.

    If you inflate values, you also inflate coverage cost. Nobody was ever charged in history for paying more for coverage to increase coverage on a property.

    That doesn't even make sense as there is a Trump name brand and its the insurance companies call to provide the coverage under those specification.

    Nonsense. You can challenge your property values all you want for what ever amount you want but if it isn't cut and dry as to the property assessor making a mistake, your values don't change. They use comps as well. NOBODY on planet earth has EVER been charged with defrauding a county property appraiser for fraudulent property values and no property assessor will ask or communicate with you when making his assesment. Both my father and my brother in law were county property appraisers and thats just ridiculous.

    As so is the law firm who certifies them along with the law firms guarantee that any audits or charges we be defended by that same law firm.
    Always has been, always will be.

    If it was solid they would indict instead of news story after news story. And you can't challenge what hasn't been charged. Who does that?

    DAs don't do civil cases.

    The educated realize that Cohen has complete his prison sentence, so there's nothing more to reduce...

    But you bring up a great point (??).... will Cohen be called as a fact witness in any civil or criminal trial against T**** or his criminal organization?? He knows a fair amount about how the schemes worked, and he was a reasonably effective bag man for them, but he's not really a true money guy. I suspect he'll chomp at the bit to do it, but not sure of his probative value...

    True, but others have been caught (pre-pardon) and only tripled down on their support for Orange Jesus... Cohen went above and beyond just repudiating Trump for personal gain, but he'll never be truly accepted in the massive anti-T**** world either.

    He had Rosie O'Donnell on his podcast, for crying out loud... if that doesn't say at least partial redemption, I'm not sure what would..

    I can't even get to the rest without addressing this first. She's the AG. And, yes, this is a civil case. There is a separate criminal case with the Manhattan DA office.

    You inflate values to increase coverage, which lets you pocket a hefty sum when you submit claims (like Trump did at Briarcrest). And, no, you don't have to burn down the entire damn thing to submit a claim. Property owners submit claims for damages all of the time. They don't just sit around and wait for the entire thing to burn down.

    And, yes, that will make payments go up . . . TAX DEDUCTIBLE payments. Starting to understand?

    This is why (contrary to your previous error), no, insurance companies don't just go around insuring anything for any amount you want. They don't want the insured amount to greatly eclipse the actual value of the subject of insurance . . . for obvious reasons. No one is insane enough to insure my 2010 Yaris for billions of dollars no matter how much I pay each month. You do realize this is why insurance companies have risk analysts, right?

    Yes, it was their call. And they said not to include the brand value. The allegation is that Trump did anyway, while lying about doing so. Have you still not read this?

    It is illegal to mislead tax officials about the value of the property. Period. You can't just make up whatever you want if you know the numbers you are giving are inaccurate.

    Looks like it wasn't done by a law firm. It was done internally (which they also lied about). Regardless, "But they are guilty too, your honor!" Isn't a legal defense.

    This is a civil case. If you had followed the story, you would know that what is going on here is that she is trying to get testimony from the Trumps. Why? Because they signed onto paperwork that she is investigating as likely fraudulent. They can plead the 5th, but they are going to have to sit for a deposition. It's not like this is the first time in history this has happened.

    She isn't the DA, and this is a civil case.

    The case involves Trump's dealing with an insurance company, but it isn't about that kind of insurance. It's about surety bonds, which are underwritten by an insurance company to cover things like fines for government license breaches, liens against property, etc. They give everyone peace of mind because the insurance company, rather than the principal, guarantees they'll be paid. However, the insurance company needs to know it will be paid too, so it will consider the financial standing of the principal before agreeing to this, and would obviously expect that financial statements etc. do not misrepresent the actual status of the principal.

    Making a claim for damages would have nothing to do with the claim of the property value. It cost what it cost to repair damages. Unless there was a claim for a totally destroyed property, you have no case.

    Absolutly which is why these claims are fake. The insurance company doesn't just take Trumps word for it. They make their own assessment and decide what to charge. There is no liability on the part of the insured for the decisions of the insurance company. And if there was a claim of fraud, it would come from the insurance company, not some local DA.

    So you are trying to convince me, that a sworn state tax assessor, went against all code violations, comps, appraisals, and his sworn duty to the state, and took Trumps word for his property values out of the clear thin blue sky, that were so under inflated that Trump is being charged with tax fraud on his own property?

    Then I would say you have no clue what the liabilities are of the tax assessor as he is CRIMINALLY LIABLE for improper assessments. He is required to defend his assessments to the IRS and the states revenue board. If there is any discrepancies in his assessments to the state revenue board he is required to defend his assesment with his own research and documentation.

    That law firm is REQUIRED by the IRS to defend any tax litigation from their prepared returns or they don't get the federal tax license to prepare those returns.

    More valuable properties generally cost more to repair. Repairing a luxury condo costs more than a dumpy duplex. But you keep telling yourself that. You obviously think you know more about the law than the AG. But, if you really do think it is nonsense, why not take me up on my friendly wager?

    The allegation is that they misrepresented facts to the underwriter. Yes, that's illegal. Yes, you are liable for any lies you tell the insurance company during your application. How did you not already know this?

    Go back and read what I actually wrote.

    You are running away again. "But someone else also committed a crime" isn't a defense. And it is a crime to lie to tax officials about property values. Period. You can keep pretending it isn't, but it is.

    You actually got something right here! It was a valuations that were done internally, not the taxes. But they did lie about that to their underwriters.

    The state of NY. This isn't the first time a state AG has levied a civil case. Not even remotely so.

    The cost of repairs will be determined by the cost to repair it in its market. Not the value of the property. Thats why insurance companies decide to total a property instead of repair it.

    Which proves what? Just because you are willing to lose $100 bucks means nothing.

    I never said it was but you got it in your head that the legions of tax lawyers that are REQUIRED to defend the tax claims don't exist. They do exist and will make an idiot of this AG in court.

    Yet you have provided NOTHING that stipulates Trump lied to some state tax assessor. NOTHING. Even if a State tax assessor tried to contact the Trump org (which he wouldn't) he wouldn't speak with Trump. You are making some ridiculous claim about something that hasn't even been reported out of thin air.
    The bottom line is, if Trumps state tax revenue is that far off, the assessor has a hell of a lot of explaining to do. And he can't say, cuz Trump told me so.

    The underwriter has detailed how misrepresentations caused her company, Zurich, to make an agreement that they would not otherwise have made. Whether or not they take action independently, or if relief would result from the AG's case, I have no idea.

    We'll see, they've been desperately banging away at this for years and got nowhere. The crux seems to be that the Trump family overestimated the potential value of their properties but you'd have to establish criminal intent to prove a case.

    This isn't a criminal case. There is a SEPARATE criminal investigation, but this is a civil investigation.

    But lol at the "overestimated." This was obviously intentional.
