Georgia DA requests special grand jury in Trump election probe

    I'm pleased to see this progress. Hopefully the DOJ is looking into similar considerations and that other states are doing the same. We can't take this steal attempt lightly.

    Don't be surprised when this request is denied. The requester is the Fulton County DA. What they want to empanel the Special Grand Jury for was something that happened at the state level. Therefore, this even is outside a county DA's jurisdiction. If a Special Jury was necessary, then it would be up to the State AG to request it.

    This is nothing more than a political grandstand. So, my recommendation is not to hold your breath.

    In a unanimous decision the court granted the request to empanel a special grand jury.

    So, a Fulton County Judge approved a Fulton County DA's request. You assume that is the endgame, but it is not. Next the Special Grand Jury will have to send out subpoenas. Who will they Subpoena? Why the only ones that were involved in the conversation. The Georgia Sec of State and former-President Trump. The Sec of State will be the first to act. He will petition the State Court of Appeals to squash the subpoenas. The stated reasons will be; 1. The Conversation was a state matter, and outside the preview of the County. 2. The Fulton County DA's motive for empaneling the Grand Jury is due to the fact that the County's Election Board is under investigation, and several of the election workers were fired. 3. The Federal Government has already investigated the conversations and found that no laws were broken.

    So, stay tuned for further developments.

    I never assumed it was the endgame. I just observed that your whole prediction about the request being denied was incorrect. And they mentioned that several witnesses would not testify without a subpoena, so the idea that those are the only two people who will be subpoenaed is nonsense. Add to that the fact that they've openly stated that the call is NOT the only thing they are investigating.

    And when did the DOJ determine that no laws were broken? Even if they had done so, they can only determine FEDERAL law breaches. FEDERAL. This is now a STATE issue. So, yes, stay tuned for further developments. And maybe read up on the current developments.

    Unless there were others that were privy to a conversation between President Trump and the Georgia Sec of State, no one needs to testify. That does not mean that the Fulton County DA will not trot out a host of individuals that claim that they heard something from someone that was not actually in the room during the conversation like the Democrats did during Trump's two Impeachment hearings. Hearsay evidence is allowed in front of a Grand Jury, but in the end, there are only two testimonies that will be relevant, and both of them will require a subpoena to compel the testimony.

    Who would be responsible to determine whether state laws have been breached? The State or some grandstanding county DA/Judge? Again, a County DA or Judge does not have the authority to hold the state accountable. Even if this Special Grand Jury did level charges against President Trump, it would fall to the State Attorney General to investigate the validity of the Charges and to decide whether to move to trial. With a GOP AG, the chances of that happening is slim to none. Why? Because no laws were broken. If you disagree, then please tell me what Georgia statute was violated. Otherwise, don't bother responding.

    There weren't just 2 people on that call, and the call isn't the only thing being investigated. If you really think the AG would somehow block this investigation even if a grand jury recommended charges, then all you are doing is trying to normalize corruption.

    As far as laws broken, James has listed out the potential criminal acts she's investigating.
