Supreme Court Justices React To Boston’s Refusal To Fly The Christian Flag

    WASHINGTON (AP) — Supreme Court justices seemed to have little doubt Tuesday that Boston was wrong to refuse to fly a banner described as a Christian flag outside City Hall.

    Arguments at the high court appeared to unite justices on the left and right in favor of Harold Shurtleff, a conservative activist. Shurtleff wanted to fly a white banner with a red cross on a blue background in the upper left corner, called the Christian flag.

    There are three flagpoles outside City Hall that fly the U.S., Massachusetts and Boston flags. Occasionally, the city takes down its own pennant and temporarily hoists another flag….

    This associated press news article about the Supreme Court and the case of Boston and flags is interesting. It seems like it’s going to be a discrimination issue rather than a separation issue. Boston has allowed all sorts of groups to use all sorts of flags for various occasions over time. The Supreme Court is going to rule on the matter.

    It seems that this is a view point discrimination case rather than a separation issue as Boston hoped. Boston officials were using the separation argument as a tool to engage in view point discrimination against the Christian religion after allowing so many other flags for so many other occasions.

    Bottom line is that if they do an activity they can not exclude certain citizens from participating equally in it. The Supreme Court clearly does not see this as an establishment issue.

    Well, I guess that's the case right there isn't it. I don't like it but I won't lose sleep if they let it happen. It will be interesting when the other religions want to do the same.......of course, I don't think any other religions have a "flag". I mean really, WTF is that about? I thought that went out with the Crusades.

    I think the ACLU nailed it here:

    "“We have long expressed concern about government endorsement of religion, and have sued often to enforce the Establishment Clause,” stated ACLU National Legal Director David Cole.

    But when the government opens a forum to private speakers generally, as Boston did here, it can’t turn away a speaker simply because it is religious.” "

    It may or may not be worth noting that the flag in question, 'The Christian Flag' is specifically a protestant flag. Boston is something like 10% Protestant and 50% Catholic. Gotta wonder if that has anything to do with it...

    So typical of the bi coastal secular progressive urban elites attitude. Attack Christians and compare our symbols to the most vile and evil organizations in the world that must be allowed if the Christians get to display our symbol.

    I don't support a Muslim flag, a Christian flag or a Gay Pride flag.

    However if they are going to fly the flag of a subversive violent hate group like the one above, then they sure as hell have to fly the flag of the WASPs that founded and made this nation great. America is no longer great and it is impossible for it to ever be great again. Asia is the future, they still have an identity and a purpose. America has neither. America has Balkanization which will lead to collapse or Soviet style authoritarianism. I don't know which will come first but I hope I am not alive when it inevitably happens.

    Claiming that this is not a "religion" case is ridiculous.

    Of course any "group" has a "right", but the establishment clause specifically singles out "religion" in that separation. It specifically separates church from state, but allows religion in politics.

    IMHO, this is clearly enjoining church and state by allowing a church to hang their flag on the "states" building

    I have little doubt that Boston would not have to be "forced" to fly the gay pride flag. They'd do it gleefully, which is why this is an act of viewpoint discrimination.

    If Boston didn't allow any private flags to fly outside their buildings, they could plausibly make this argument. Allowing other groups to fly their flags, and then trying to restrict the Christian one, is viewpoint discrimination.

    That would be like saying that secular speakers are allowed to speak on a soapbox in the public park, but religious speakers should be barred. It's an absurd perspective, at odds with a Constitution that prohibits the free exercise of religion and the abridgement of the freedom of speech.
