DeSantis suspends Tampa prosecutor who vowed not to criminalize abortion

    This is a joke, right? You're not actually trying to defend your ignorant mistake, are you? That would be absurdly stupid. You described it as "a law that is currently struck down by Florida courts", but it's not. It has not been struck down. The original judge issued a temporary injunction. That's different than a final ruling on the merits of the case (which has not been made yet). But that temporary injunction has since been overturned by the appeals court. Right now, today, if an abortion provider in Florida performs an abortion on a 16-week-pregnant woman (that doesn't qualify for one of the exceptions), they'll be violating Florida law, because, again, the law is not, in reality, "currently struck down".

    There's nothing pending before the appeals court anymore either, at least as far as I know. Judge Cooper is free to proceed with the case on the merits, but in the interim, the law remains in effect (because, again, it's not "currently struck down" / enjoined / anything else. It's in effect.).

    A Florida law that Judge Cooper had stated and I quote “violates Florida’s Constitution”. It does it is exactly what Mr. Warren has stated.

    If you want to talk I will continue to discuss. If you just want to be an ******* with your comments you can move along. I can go do either or. Your choice.

    I’m sure you are aware the stay has nothing to do with the constitutional question of the law and was merely due to an appellate rule for appeals.

    You understand that right now, in Florida, abortion provides are (largely) prohibited from performing abortions after 15 weeks, right? You get that HB 5 is in effect in Florida today, don't you? And yet you still chose to describe it as "a law that is currently struck down by Florida courts"? You consider that an honest and accurate representation of the reality of the current legal status of HB 5?

    I agree that due to an appellate rule that yes the law is allowed to be in effect. I believe that when the appeals court hears the case, it will be confirmed that’s the law is unconstitutional following years of Florida Supreme Court rulings. I believe that Andrew Warren is correct to not prosecute anyone seeking abortion

    So to the Original OP!

    Desantis has lied.

    Because zero abortion after 15 or 24 weeks have happened. He lied about it being because Warren was “Woke” He was following the Florida State constitution which he is sworn in to defend and uphold.

    Warren will be back in office and the last person Ron attacked is going to end Matt Gaetz career and become a congress woman.

    he is obviously refusing to uphold the law. If he refuses to prosecute there obviously won’t be any cases for an example.

    The appeals court already heard and ruled on the only motion before it regarding this case, a couple of weeks ago. This isn't just the automatic rule that suspends the temporary injunction upon appeal, the appeals court went on to hold a hearing and rule on the matter, on July 22.     Let’s see, pretty sure that was the one the clinics and doctors were filing. The ACLU is the one that was filed in regards to Section 23 of the Florida constitution.

    You keep repeating that butbIbfind nowhere where he saidbit violated the Florida constitution and he is not the arbitrator of such a decision that would be the courts. Until they rule it is he must enforce it and he is refusing to do so.

    There has been nothing to enforce. That’s the point. There have been zero cases of an abortion at this State at 15 weeks or more. Hell only 2% of abortion in Florida were over 15 weeks.

    You guys just support your party throwing out another parties elected member. Just remember this stuff can go both ways. The gauntlet has been thrown

    There is a law duly passed by the state legislature which he believes he can veto and refuse to enforce. He signed his name to that proposition.

    You seem to think there are two separate lawsuits going on in Florida over HB 5. I'm pretty sure they're actually one and the same. Scroll down to the last paragraph of the last page of the appeals court ruling I cited and I think you'll probably agree with me again. If you're still in doubt, maybe take a look at this:
