US supreme court to decide on Trump’s claim of presidential immunity

    There's already a law in place. The impeachment clause. Nothing else will do. Congress cannot possibly write a law that could cover every type of circumstance that may come up. No one can. That is the problem. You're just going to have to be satisfied with what we've had, and dealt with, for well over 200 years.

    can other presidents do the same and not face consequences??

    No, it should not be left to SCOTUS to make the Law.

    You can write a Law which says that It is lawful for POTUS to authorise the killing of an enemy of the USA. It could be as short and sweet as those words in red italics.

    Impeachment isn't up to SCOTUS. Its up to Congress.

    And your suggested law does not cover everything still. Think killing is the only thing that a POTUS may authorize which could be considered illegal for a normal civilian?

    It can be described in general or specific terms in the Bill and if not, then the Courts can decide after the fact.

    The poster I was responding to wants Congress to write a law detailing what a President could be immune for prosecution for. I was challenging that poster to think how such legislation would be pretty much impossible to write as it could not possibly cover all situations in which a President may need immunity for since they are at times required to do things that no normal civilian would ever get away with. My questions and statements have nothing to do with Trump. But ALL Presidents, no matter the party affiliation or person.

    The point is that every sentence in every Bill is made up of words and if there is a dispute about what they mean, then it's over to the Courts to decide what they mean in any given context. That's why Courts exist.

    Which is exactly what we have going on now. The question of immunity is before SCOTUS. Yet here you are hollering about it in this thread saying that it shouldn't be up to SCOTUS.

    Your problem is in thinking that because its not explicitly spelled out then it doesn't exist. I've shown you why its not explicitly spelled out. Because its not possible to cover every base that may be needed. Your insistence that it should be is a futile insistence. It will never be spelled out. Even if you had a completely co-operative Congress/President it never will be because the government, ANY government, would 1: not constrain itself in such a fashion. (I'll bet your PM could do things no civilian in your country could do legally...and its not explicitly spelled out I'll bet also). 2: its simply not possible to cover every instance that would be needed.

    The immunity has always been there. Nothing will change. And the examples given are the extreme's. Not likely to happen...and if they ever did...well...that's what the 2nd Amendment is for if worst comes to worst.

    If it is not expressed in Law, then it does not exist.

    And no, our PM is not above the Law...ever, not in any circumstance. He has zero immunity. There is no Law granting him any immunity, and he could not ever get away with magically claiming he is a God King.

    Just like Boris Johnson had no immunity from the UK's Covid Laws.
