    Supreme Court Justice Sotomayor sounds alarm in fight to overturn Roe v. Wade

    Supreme Court Justice Sonia Sotomayor on Wednesday expressed fear that a bid to overturn decades-old abortion rights, if successful, would destroy the public perception of the high court, and thus the institution itself.

    “Will this institution survive the stench that this creates in the public perception that the Constitution and its reading are just political acts?” asked Sotomayor, one of three liberal justices on the nine-member bench, at the start of oral arguments in a case challenging Roe v. Wade and Planned Parenthood v. Casey.

    “I don’t see how it is possible,” Sotomayor said.

    Sorry Sonia, but that horse has left the barn. The court is already perceived as being a political institution because it is one. How could it not be given the issue oriented litmus tests both parties apply to nominees? How could it not be given McTreason's incomprehensible abuse of power in facilitating the court being packed with extremist conservatives?

    The perception will continue no matter Roe's fate. It's part of the politically polarized world in which we live.

    This administration has one... but only one opportunity to get the Supreme Court back on track. And that's for Biden to send at least three independent candidates for Justices to the Senate for confirmation. And to keep submitting them until they are confirmed.

    The court is lost to conservative extremists for a generation. Not much of anything Joe can do.

    There is nothing that prevents him from appointing more justices. And it looks to me like that's exactly what Sotomayor is hinting he should do in the statement you quoted.

    I would consider it a huge failure by this administration if the partisan Republican justices overturn Roe v Wade (or if they side with any of the upcoming cases meant to perpetuate Republicans in power), and Biden fails to act decisively. We have had Presidents who have HAD to make very tough decisions, even if it costs them politically. Lincoln had to do it. We shall see if Biden has the guts. If he doesn't, he needs to stand aside and let somebody who CAN do the job take over. I would be front and center asking for his resignation.

    What tough decision are you referring to? You mean packing the court if the decision doesn't go your way?

    Liberals only feel this way regarding this case, not at large. Which is tragic because it is the correct feeling. The US Republic, 50 states and some 330+ million people large has outgrown the existence of the Supreme Court. It is not possible(and Jefferson didn't think it possible at the beginning of the Republic) for the Court to render political rulings(which is what they are, and always have been Ms. Sotomoyer, even at the beginning of the Republic) and for the nation to be quelled by this supreme ruler called the Supreme Court.

    In fact, the existence of such a court make conflict inevitable in that neither of the parties were truly satisfied with the ruling. They merely had to 'respect it', until such a ruling where the respect won't come. In truth, the Nation-State must be able to determine its own political-social future. Civil rights were not granted by a court, they were granted by the resolution of the social conflict(that is not to say that every conflict should or need be resolved by conflict(ie: force of arms) in fact, I'd hope 99% aren't.)

    But that these political existences only can be resolved by the political forces that exist, not by an external outside ruler. Courts should only apply to criminal court cases. Were it up to me, SCOTUS would be disbanded entirely and we'd be left with the federal courts for criminal court proceedings.

    I realize that there are strong feelings on the issue, but that does not justify government interference in ones right to bodily autonomy. Before you know it, government will be forcing people to have pharm products injected into their bodies if they want to remain employed!

    As plainly evidenced by her complete disregard for judicial procedure and decorum. No judge, let alone a Supreme Court justice, is to comment in any way shape or form on an upcoming hearing or trial. She is obligated to recuse herself.

    The Senate cannot legally block him from nominating more Justices. They are required to hear the nominees and they can raise objections against one particular nominee. At which point Biden simply nominates somebody else. But they will have to VOTE against that nominee. Constitutionally they CANNOT impede him from adding justices to the Court.

    If the Senate chooses to act in dereliction of their Constitutional duty, then Biden can appoint them during Senate recess.

    There wasn't any Court packing of conservatives the only thing that happened is they replaced Supreme Court justices which is their job.

    But she was talking about this one case affecting the reputation of the court. She is completely out of line.

    It's a sad day when SCOTUS becomes political - and that's exactly what this looks and smells like. It will be very hard for the court to maintain the faith of the population when decisions such as these are made based upon political lines and leanings.

    A bipartisan White House commission agreed that Congress has the legal power to expand the Supreme Court — but the group was divided on whether lawmakers should actually do it.

    That’s according to draft “discussion materials” released Thursday by the White House, which tasked 30-odd experts with considering an array of possible reforms to the nine-member high court.

    The draft materials came out as the court, facing all-time low approval ratings, is set this term to deliver rulings in pivotal cases that center on politically polarizing issues, including abortion, guns and religion.

    Not being willing to meet the Repub's relentless, 40 year strategy to overturn Roe with equal energy is going to result in it either being overturned or essentially gutted. It's been fine for Repubs to fight the war for decades.
