California passes anti-1st Amendment law. What is the point of The Constitution if this can happen?

    I can't quite believe that such a law has been passed and an AUSTRALIAN is the first person to make a thread on it! (I did do a thread search.) Perhaps this is because anti-Constitution laws are passed all the time in the US and as such its not a shock anymore?

    I'm actually sat here wondering what the point of The Constitution of the United States of America is if anti-Constitution laws are passed. Does this have precedent?

    But to answer the OP author, yes it is true that nobody bothers with the insanity coming out of California any more, because under TOTAL Dem Party rule it is now strictly controlled by the farthest Left of the Party's radical political extremists. It will be this way until finally the federal government declares martial law and goes in and cleans out the overflowing leftist ideological cesspits.

    You are obviously surprised due to your preconceived belief that public shaming of citizens based on your personal opinion is protected by the first amendment. Fortunately you are free to think this, but you are not free to inflict it upon everyone else.

    It's California and they have a lengthy history of skating on thin Constitutional ice in the ramming of liberalism sideways down the gagging throats of thinking citizens. But fortunately for the leftist rulers of the State of California most people inclined to think and reason to logical conclusions have already abandoned that state. So yes, California's latest insanity violated the U.S. Constitution, but unless or until the federal government is ready to declare martial law and 'fix' what leftist rule has systematically broken, it increasingly is going to devolve into a rogue state existing outside the U.S. Constitution.

    I think you have to ask IT what IT wants to be called and then you are legally obligated to address IT by that designation even as IT tries to decide which toilet facilities to use . . . for that day. It's California!

    Old people are already treated like **** in nursing homes by sadistic maggots who work there.
    How many horror stories have we seen over the decades about how staff at homes and asylums treat patients?
    It's sad that, on top of all that, other people are so insecure and bigoted that they can't show others a basic level of respect in how they address them.
    Only a puerile homophobe gets so bent out of shape over such a trivial thing.

    I live in California, and the kooks in Sacramento are the idiots that will hang themselves. Particularly with gun laws. Once California’s stupid laws are overturned by the Supreme Court, the effect is nation wide. A blessing in disguise but you have to be patient.

    Catering to people's mental illnesses is not showing them respect, it's humoring them in an unhealthy way. Making refusing to cater to someone's mental illness a crime worthy of jail time is another level of insanity on top of that.

    It doesn't matter what it is limited to. The poster is right. Government made a law to punish someone for speech. Nursing home employees can be fired by their employer, but under the constitution they cannot be persecuted by government. Nursing home employees have rights under our constitution.

    If law was created by our government to fine or jail sports people for kneeling during the anthem...it would be in the same category.

    The media is missing this on purpose and I do think it's a big deal. The ACLU should be on it...or someone who cares about nursing home employees should be sueing.

    You have to have an aggrieved party to do the suing, an actual nursing home employee, for instance. The ACLU these days would probably weigh in on the side of the mentally ill person, i.e., the tranny. Nursing home employees are trained to humor their patients anyway, so I doubt you'd find anyone who would even challenge the law. "I'm a woman!" "Yes, dear, whatever you say... mind your balls on the edge of the bed, dear."

    It will end up in the courts at some point and be tossed out. But States can try to pass any law they want.

    Uhm...as I mentioned in the other thread that already exists on this topic, that stuff about pronouns is absolute nonsense. I've read through the linked bill twice, and it doesn't say a word about usage of pronouns. It's a rather standard bill about the rules regarding licensing for senior care homes.

    This is a smooth move by California liberals, I mean, who is going to argue against protecting the respect and dignity of senior citizens? The problem is, these are senior citizens, they're too old to believe it's trendy to not be the sex they are or their parents probably never indoctrinated them when they were young because being a tranny wasn't in style back then and was just considered a mental illness.

    This is just the first move to forcegully normalize the behavior of calling someone by the gender they chose to be instead of the gender settled science gave them. You watch, this is going to spread to every corner of CA, every business, school, park, boat, plane, airport, everything.

    I'd like to encourage the insane people running California to take it even further.

    Let Moonbeam write a law declaring California a marxist state, another law making the minimum wage $7000 dollars an hour, another law making following the law illegal, and go from there.

    You are talking out of your ass. I don't even think you have any concept of what the 1st Amendment is or means.

    The First Amendment, is a Negative Right. That means that there shall be NO LAW made infringing it. The California Legislator just did that. The OP is in the right and I don't know where the hell you are.

    This is what authoritarians do. They chip away at our freedoms until they think they have enough power, then they clamp down hard. Every freedom loving American, left or right should be rejecting this type of tyranny.
