If the FBI recommends indictment of Hillary Clinton to the DOJ and the Attorney General refuses to follow up with charges, can she he prosecuted for obstruction of justice?
She is not above the law. Someone must be in a position to prosecute. I don't know the answer so that's why I asked the question. I suspect the legislative branch would first have to impeach the AG and then there would be some mechanism to formally press charges but I honestly don't know how that works.
It depends on what the law is. Generally it takes a prosecutor and a judge to indict someone. Since the Attorney General is the head of the Justice Department, he wields a huge level of influence over all the other prosecutors, and usually has the ultimate say over whether the Department chooses to charge someone. So it would be very difficult to prosecute the Attorney General without the support of the President. Prosecutors can often be very reluctant to prosecute someone with a lot of power who could turn around and get them accused of a crime in retribution. And no official is more powerful in this regard than the Attorney General.
Yes... But that won't happen given the overwhelming evidence against Hillary..... Lets not forget Hillary aids have already been granted immunity to talk - how on Earth does that happen if they don't plan to prosecute? Hillary is super done.

I don't know all the legal details of Watergate (I was born in 1980) so I couldn't tell you but I would assume that would be the case... I will however tell you this Hillary stuff is bigger than Watergate.... Watergate is fluff compared to what is going on today with these politicians..
Since you were born in 1980 and admit that you know very little about Watergate, you might want to read a book about it before you attempt to argue with people who lived through it. The email issue is nothing really. Watergate though was a much bigger scandal that was leading to full impeachment of the POTUS and his eventual resignation. Many of his crew were sent to federal prison as a result of their crimes. The server issue is nothing more than right wing fantasy.
I know about Watergate and law, I only admitted to not reading all the files (as if anyone could) you're talking semi trucks of paper... Hillary is (*)(*)(*)(*)ing guilty of treason and conspiracy to commit treason..... She basically ran a branch of government from her own server KNOWINGLY all documents WOULD NOT be subject to FOIA requests and she laughs it off like a crazy clown psychopath...

Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States. It is almost impossible to be tried for treason and convicted. You do realize that previous cabinet members also used private email servers...did Faux News ignore that factoid from you? On a more personal note, perhaps you should not frequent blogs like this due to your temperament, it seems you have a tendency to become unhinged at the very hint of another point of view.
Does this occur before or after 1) Democratic convention, 2) General election? 1) If this occurs before the nomination, HC will face enormous pressure to withdraw. Superdelegates can read the writing on the wall. 2) If this occurs before the election, HC will lose to Trump (or Cruz). The important point is that such a recommendation from the FBI (if it actually occurs) cannot be kept quiet. Once it becomes public knowledge, HC is finished politically whether or not a prosecution follows.
All the wingnuts can dream on. It's not gonna happen period. Far more have done just as bad or far worse and gotten away with their misdeeds. Bush and many of those in his Administration come to mind. As well as Reagan, Contra affair and all.
The most likely outcome will be a slap on the wrist for sloppy handling of security. This is just my opinion, of course. The decision will be made by Comey, and not by any of us here. Wishful thinking seems to be strong on both sides.

So you don't know the 'legal details' about Watergate, and even though the investigation isn't over or all the facts known about the email issue, you know it's bigger than Watergate (insert facepalm) Nixon personally authorized a Federal crime. Then he personally destroyed evidence of that crime and personally organized a coverup of that crime. Knowing what you're talking about is usually a very helpful thing.
