There are still outstanding lawsuits against NBC, ABC News, CBS News, The New York Times, Rolling Stone and Gannett. The Enquirer is owned by Gannett. CNN and the WaPo have settled. MSM needs to pay big time!

Sandmann's lawyer believes he has a slam dunk case, but settles for an undisclosed amount of money. If taking CNN & MSNBC to court would get him more money, why would he settle?

Because CNN would draw it out for many years. Settlement is the name of the lawsuit game.

 

Settlement amount are on a case by case basis. Its not one size fits all. If you want to get an idea of what a settlement might be, you have to consider the following.

1. If the defendant (CNN/WP) refuses to answer the complaint (which if they do is public information) within 30 days they lose by default.
2. If they do answer the complaint and provide false information it becomes a 57.105 hearing for falsifying information to the court and the trial goes on. Not to mention sanctions against the attorneys and defendant for knowingly falsifying information to the court. Then that information can be used in the trial. Which is also public information.
3. If they can't answer the complaint without exposing themselves for liability, they have to settle the case before the 30 day deadline to keep it out of the court and out of the public domain.

If this was a nuisance case with no evidence, the defendants would answer the complaint (public information) and file for dismissal. Even if they lose the dismissal, the plaintiff will be about 40K involved at this point. This is when a settlement is offered because it cheaper to settle than pay the attorneys to fight it.

No high profile law firm will walk away from a contention case like Sandmans over a few hundred thousand when the defendant can't even answer the complaint because they have video evidence of their claim. I don't think he got 250 million, but I guarantee you they got at the very least, half. Not to mention the WP settled even faster than that.

You can think what ever you want but I have been involved in cases like this and NOBODY settles prior to answering a complaint unless they know they are going to lose huge. NOBODY. EVER.

 

I think you are right, I haven't heard that he paid anything. But he was the aggressor, I wonder if anyone on the left would be ok if a Trump supporter wearing a maga hat got right up in their face and banged a drum chanting Trump Trump Trump over and over an inch from their face, would that not be a form of assault?
