GOP lawmakers, NRA slam ATF rule to regulate pistol braces: 'Unconstitutional overreach'

    a violation of the constitution? I think so. First of all there is no article that grants the president or any agency the power to restrict arms. In fact that power isn’t granted to anyone or any government level. That ability is constitutionally restricted from all forms of government. The founders did not add “shall not be infringed” as a joke as Biden wants you to believe.

    That said, let’s play off of the belief that the second isn’t absolute. That presidents can make rules to ban guns and gun accessories at the drop of a hat without legislative approval. What good is the constitution if a single dictator can direct new rules against the constitution? What is the constitution even here for if that is possible? Where is the separation of powers? Where is the citizens right to private property? Where is the citizens right to bear arms? Where is the citizens right of representatives? This is so unconstitutional it’s sickening. Not even their elected officials can weigh in. The constitution means nothing to people who support this action. It violated it at every corner.

    I spent three hours reading the 200+ page explanation by the ATF on why they are doing this. the 1934 NFA is blatantly unconstitutional as is the regulations concerning SBRs. The USSC needs to start eviscerating this nonsense. I was an AUSA for 24 years and I cannot tell which firearms are needing registration (albeit they are waiving the 200 dollar fee). I know dozens of people who bought these pistols with braces on reliance of earlier ATF action and now the Biden administration, along with the (thank god for Mitch McConnell on this) not on the supreme court Merrick Garland, are just trying to harass honest gun owners

    The communist liberal/Dems are chipping away at our rights every day. I have no personal interest in these braces (trying to get rifle performance from handgun ammo is a an exercise in futility), but its a matter of principle.
    What is the "AUSA" you refer to? In my world that's "Association of the United States Army"... but I don't think that's what you meant.
    I hope we can make it until we throw the bums out.

    Much like any authority not granted by the Constitution the government just goes to court and decides that they can make up these rules because the Court said so.

    My step brother is an Italian married to a black woman and they are both lawyers, of the liberal progressive sort.... I am exceedingly glad I live 100 mi away.

    Not too far away to miss Thanksgiving and stuff like that but far enough away to miss everything else!

    I am also a professional shooter and shooting and archery coach. my bar license is inactive meaning I am in good standing but no longer practice. I teach kids how to shoot

    Very cool. I taught young folks how to shoot as a Basic Training Company Commander at Fort Leonard Wood. Later, as a civilian contractor, I did the same with the NEW Iraqi Army at KMTB (Kir Kush Military Training Base).

    Too many civilians think learning "to shoot" is just about hitting the target. The military sees that as just the first step. The levels of small arms training in the military include:
    Individual - how to load/operate/maintain your weapon and hit the target
    Crew - How to operate a crew served weapon like a machine gun
    Team - How to shoot and move with other members of a team... as the name implies
    Combined Arms - How to shoot and move with other arms, especially Armor
    Joint - How to work as a member of a team that includes other services... Army, Navy, Marines, Air Force...

    From individual training on, the emphasis is not only on shooting, but how to NOT GET SHOT. I attended a local civilian training course and was flabbergasted when I saw the exercises consisted of standing up in a line in an open field shooting at targets. Being the best shot in the world doesn't help if you're dead.

    the shooting school I have attended many times as both a student and as an instructor is big on moving-moving while shooting and getting to cover, using cover etc. I did have a narc from Detroit tell me standing in the middle of the street might be the safest in his world since the strung out junkies are more likely to hit someone behind cover with a ricochet than someone standing 20 yards in front of him wide open

    I don't see how this pistol brace bullshit or even the NFA as applied to SBRs or suppressors survives a Bruen inquiry. On top of that is the issue of detrimental reliance. I bought a SIG pistol based on the ATFs prior ruling. I would not have bought it if I had to pay a 200 dollar tax and registration requirements. I relied on the ATF's position =that is an issue many judges hate-and the government should be estopped from changing its position even if they claim they are waiving the fee of 200 dollars

    most of the people I know who have these pistols are going to wait 30-90 days and see if this complete pile of bovine excrement survives the court challenges that were actually filed over a year ago but stayed when the ATF backed off its reversal over prior rulings. I suspect the first case will be decided in Texas and I think the texas judge will strike the ATF crap down

    BTW if you turn on the Repeat of the FBI show on CBS right now, you will see why so many sheeple spout idiocy about "assault weapons" This show, while well made, has all the gun banner arguments presented to the viewers-this episode on now is about a gun runner and his family murdered by some mopes who take the guns the murdered family's wife and unslain sister bought in Georgia. IT alleges you can buy real assault rifles in Georgia and that Northern Gun problems are due to (non existent) laws in the south the allow out of state citizens to buy rifles and handguns from licensed dealers. Indeed, just seconds ago one of the hijackers guns down a state trooper with a FULLY AUTOMATIC M4 rifle and screams GOD BLESS THE SECOND AMENDMENT.

    in this show we have had the following

    1) people buying brand new machine guns in a licensed shop
    2) a background story about a school shooting using "military style assault rifles"
    3) a repugnant individual on a news cast who is basically portrayed as the head of a gun rights group showing no concern for children being murdered (#2 and #3 have nothing to do with the plot)
    4) cops being shot down with fully automatic firearms recently bought at a dealer
    5) lead characters damning weak southern states laws as being responsible for violent crime in places such as NJ, PA and NY
    6) a parent of a slain child whining about banning "legal military assault rifles" (no one has ever been killed in the USA by a privately owned legal military assault rifle)
    7) portraying the father-who buys a stolen rifle and takes the head of the NRF (NRA) hostage-sympathetically rather than damning him as a nut case felon

    its propaganda pure and simple and omitting it would not have detracted from the plot
