Supreme Court to Hear Case on State Legislatures’ Power Over Elections

“The Supreme Court’s decision will be enormously significant for presidential elections, congressional elections and congressional district districting,” said J. Michael Luttig, a former federal appeals court judge. “And therefore, for American democracy.”

Protections against partisan gerrymandering established through the state courts could essentially vanish. The ability to challenge new voting laws at the state level could be reduced. And the theory underpinning the case could open the door to state legislatures sending their own slates of electors.

It is one thing to agree to hear a case, of course, and another to rule on it. But four justices have already expressed at least tentative support for the doctrine, making a decision accepting it more than plausible. The court will probably hear arguments in the fall and issue its decision next year.

    https://www.nytimes.com/2022/06/30/us/politics/state-legislatures-elections-supreme-court.html

The fact that the Court is even willing to hear a case involving this crackpot theory is disturbing in and of itself.

The Constitution specifically grants the State Legislatures, not the State Governor, nor the State Courts with the power to determine how federal elections will be held in their states. The Framers picked the State Legislatures because they are the state elected body that The People have the greatest power over. The problem for many on the Left is that they are not fans of Free People ruling themselves, whis is what American constitutional Liberal Democracy provides.

AND THAT PROBABLY SHOCKED THEM: No Dem Bounce from Roe Repeal: Emerson Poll.

"The prime obstacle to Democrats this November is Biden’s approval rating. One of the main predictors of how the incumbent’s party will perform in midterm elections is the president’s approval rating. Biden’s job approval is poor; recent polls have it between 41 percent and 35 percent, significantly worse than where former President Donald Trump was at this point in his presidency. As a general rule, people who like the job the president is doing are likely to vote for his party, while people who dislike it are likely to vote for the opposing party."

And even though Trump's approval rating was stronger than post-cog Biden's, we lost a lot of seats in the mid term.

Post-Dobb generic congressional ballot is R+3, that same as it was pre-Dobb.

Pre-Dobb, Trump was +2 in a hypothetical match up with Trump, post-Dobb, Trump is +5.

And while Cheney and the Dems dither on Trump revenge porn, inflation burns down the economy:
"According to the Emerson poll, the most important issue is the economy. Fifty-eight percent of voters said it was their top issue, a nine-point increase from May. Voters give Biden even lower marks on handling the economy than they do overall. Biden and the Democrats are in major trouble, and it doesn’t seem like the decision in Dobbs will be able to save them."

    #SHUTUPANDFIXINFLATION!

Ryan Kelley was arrested for his role in Jan. 6. Now he's a front-runner in Michigan’s GOP primary for governor.

KALAMAZOO, Mich. — Ryan Kelley was an afterthought in Michigan’s Republican primary for governor — a real estate broker who served on a local planning commission while cultivating a following on the far-right fringe.

But since the FBI arrested him on misdemeanor charges for his role in the attack on the U.S. Capitol on Jan. 6, 2021, he has emerged as a front-runner. Maybe the front-runner.

No one else in the race, Kelley bragged here last week, showed the devotion he did by being on the scene of what turned into a deadly riot aimed at keeping then-President Donald Trump in power. In a GOP field scrambled first by the disqualification of two leading candidates and then by the FBI raid on his home on the day the House Jan. 6 committee began its nationally televised hearings, circumstances have conspired to catapult Kelley to the front of the pack.

‘New Lows’: Kinzinger Posts Audio Of Violent Threats His Interns Have Had To Field For Him

Rep. Adam Kinzinger (R-IL), one of two Republicans who serve on the Jan. 6 Select Committee, posted audio on Tuesday exposing the violent threats his office has received in recent weeks and months — graphic and disturbing threats that have been fielded by interns serving in his D.C. office.

In a tweet, Kinzinger shared audio that he described as a “new low” in terms of the attacks he’s received over the last few years. Kinzinger has faced backlash since he became a vocal critic of former President Trump following the deadly Capitol insurrection last year.

The video — which Kinzinger noted was compiled by his new interns, who are in high school or college — contains audio of voicemails and phone calls with profanities and ominous language threatening the lawmaker and his family’s safety. Some of the callers are heard attacking Kinzinger for his defiance of Trump.

Not really new lows, the new norm, as Repubs increasingly see violence and threats thereof as an acceptable means of politicking.

Next Time Trump Tries to Steal an Election, He Won’t Need a Mob

This radical interpretation of the Elections Clause of the Constitution also extends to the Presidential Electors Clause, such that during a presidential election year, state legislatures could allocate Electoral College votes in any way they see fit, at any point in the process. As I argued earlier this year, we could see Republican-led states pass laws that would allow them to send alternative slates of electors, overruling the will of the voters and doing legally what Donald Trump and his conspirators pressured Republicans in Arizona and Georgia to do illegally. Under the independent state legislature doctrine, the next time Trump tries to overturn the results of an election he lost, he won’t need a mob.

There are many problems with this doctrine beyond the outcomes it was engineered to produce. Some are logical — the theory seems to suggest that state legislatures are somehow separate and apart from state constitutions — and some are historical. And among the historical problems is the fact that Americans have never really wanted to entrust their state legislatures with the kind of sweeping electoral powers that this theory would confer.

Ballot drop boxes not allowed in Wisconsin, state Supreme Court rules

MADISON, Wis. — A divided Wisconsin Supreme Court barred the use of most ballot drop boxes on Friday and ruled voters could not give their completed absentee ballots to others to return on their behalf, a practice that some conservatives disparage as “ballot harvesting.”

It’s a ruling feared by voting rights proponents, who said ahead of time such a decision would make it harder for voters — particularly those with disabilities — to return their absentee ballots. Many Republicans hoped for a ruling that they said would help prevent someone from casting a ballot in the name of someone else.

    https://www.washingtonpost.com/politics/2022/07/08/wisconsin-ballot-drop-boxes/

There is no defensible rationale for the ruling since we don't have a problem with voter fraud. Except the huge problem of false accusations made by the Orange Menace and Repubs who want to suppress the vote.

You seem to be under the mistaken impression that anyone cares about some nobody ( we are all nobody's) on a chat board's prediction. I responded to your reasoning and simply pointed out that it was flimsy to say the least.

Sincerely, I do not care enough to bother bookmarking as if somehow in November I am going to be thinking of you or this conversation. LOL. Cmon. The reality is if you happen to be correct you will go back and brag that you had your finger on the pulse, or the more overwhelmingly likely scenario where you do not get all of them correct and you simply never refer back to this post again. One thing is for sure, you will not be wrong and then go back and point out that you were wrong.

Incendiary Republican ads boasting of ‘hunting’ rivals raise fears of violence

Before the Capitol attack on 6 January, Robert Pape, a University of Chicago professor, had studied political violence around the world but not in the United States because there had not been much to examine, he said.

Pape worries that could soon change because of politicians like Eric Greitens, a former Navy Seal from Missouri running for Senate, who recently released an advertisement in which he racked a shotgun and led a team of armed men as they stormed a house to hunt more moderate members of his own party, know derisively as Rinos, as in “Republicans in name only”.

“Join the Maga crew,” Greitens, a former Republican governor, declares in the ad. “Get a Rino hunting permit. There’s no bagging limit, no tagging limit, and it doesn’t expire until we save our country.”

    https://www.theguardian.com/us-news/2022/jul/02/republican-violent-ads-rino-hunting-permit

It's all part of the normalization of both violent rhetoric and actual violence in the POT.

An expert in political violence urgently warns: The worst is coming

The Jan. 6 House select committee hearings this week are among the most important of all, because they will foreground a topic that many Americans ordinarily don’t associate with their democracy, even after the events of the insurrection: political violence.

The Tuesday proceeding will focus on militias and paramilitary groups that helped bring us to the precipice on Jan. 6, 2021. The Thursday hearing will examine President Donald Trump’s derelict conduct as the violence raged — and how this was intimately entangled with the desire of Trump and many of his MAGA followers to overturn our political order.

But hovering over these hearings will be a broader, unanswered question: whether the United States is developing an endemic problem with political violence and, in coming years, how bad it might get.

    https://www.washingtonpost.com/opin...violence-militias-jan-6-democratic-breakdown/

How could the worst not be coming with a former prez who set a tone of violence being acceptable from the days of his campaign thru the days of his post presidency.

Arizona GOP Censures Bowers After His Jan. 6 Testimony, Claims It’s About Legislation

The Arizona Republican Party’s executive committee voted Tuesday night to censure Arizona state House Speaker Rusty Bowers (R), who recently testified at one of the House Jan. 6 Committee’s public hearings.

Arizona GOP chair Kelli Ward announced the censure decision late Tuesday night, saying that Bowers is “no longer a Republican in good standing.” She called on GOP voters to oust Bowers in the state’s upcoming primaries, where he is running for Arizona state Senate.

Neither Ward nor the censure mentioned Bowers’ testimony, during which the GOP leader described how then-President Donald Trump tried to pressure him into helping him attempt to steal the 2020 election (a scheme Ward herself was involved in).

    https://talkingpointsmemo.com/news/arizona-gop-censure-rusty-bowers

It's long been understood that to be a Repub in good standing in today's POT you must be a Trump acolyte. Everyone else is purged or compromised.

A Hidden New Threat to U.S. Elections

It’s been more than nine weeks since the Pennsylvania primary. The election is still not certified.

The reason: Three counties — Berks, Fayette and Lancaster — are refusing to process absentee ballots that were received in a timely manner and are otherwise valid, except the voter did not write a date on the declaration printed on the ballot’s return envelope.

The Pennsylvania attorney general has argued in court amid a lawsuit against those three counties that the state will not certify results unless they “include every ballot lawfully cast in that election” (emphasis theirs).

The standoff in Pennsylvania is the latest attempt by conservative-leaning counties to disrupt, delay or otherwise meddle with the process of statewide election certification, a normally ceremonial administrative procedure that became a target of Donald Trump’s attempts to subvert the 2020 contest.

    https://www.nytimes.com/2022/07/22/us/politics/county-election-certify.html

This is one of the insidious effects the Orange Menace has had on our democracy. He is a plague on this nation.

Trump-Backed Conspiracy Theorist Vies to Take Over Arizona Elections
Mark Finchem, a full-throated MAGA warrior, is a leading contender to be Arizona’s next secretary of state. He has said he won’t concede if he loses.

PHOENIX — This spring, Mark Finchem traveled to Mar-a-Lago for the premiere of a documentary advancing the specious notion that the 2020 presidential election had been stolen from President Donald J. Trump by an army of leftists stuffing drop boxes with absentee ballots. As a state representative and candidate for secretary of state in Arizona, Mr. Finchem was a minnow among the assembled MAGA stars, the likes of Rudolph W. Giuliani and Representative Marjorie Taylor Greene of Georgia.

But he still got his face time.

“President Trump took 20 minutes with me,” Mr. Finchem later recounted during a campaign stop. “And he said: ‘I want you to understand something. The Arizona secretary of state race is the most important race in the United States.’”

Arizona, of course, occupies a special place on Mr. Trump’s map of election indignities — as the onetime Republican stronghold where President Bidens narrow and crucial victory was first called by, of all networks, Fox News. Should Mr. Trump run again in 2024, a friendly secretary of state, as administrator of the state’s elections, could be in a position to help him avoid a repeat.

    https://www.nytimes.com/2022/08/01/us/politics/mark-finchem-arizona-elections.html

"He has said he won’t concede if he loses." Because the goal of the POT is to only allow people to view elections Repubs win as legitimate.

RNC links up with ‘Stop the Steal’ advocates to train poll workers

The Republican National Committee has been relying on a stable of the party’s most prolific spreaders of false stolen-election theories to pilot a sweeping “election integrity” operation to recruit and coach thousands of poll workers in eight battleground states, according to new recordings of organizing summits held this spring in Florida and Pennsylvania obtained by POLITICO.

On the tapes, RNC National Election Integrity Director Josh Findlay repeatedly characterizes the committee’s role as supporting in-state coalitions — delivering staff, organization and “muscle” in key states to the person they identify as the quarterback of the effort to create a permanent workforce: Conservative elections attorney Cleta Mitchell, who was a central figure in former President Donald Trump’s legal strategy to overturn the 2020 election.

    Dude, they want a coup.

They have known just what they are supporting for a few years now. And they don't care.

That is why I keep saying we are already in a civil. But only one side is fighting - theirs! Democrats are still treating this like some king of terrible misunderstanding.

There is no misunderstanding. They know what they are supporting. And as we saw on Jan 6th, they want to kill people. They said so. [of course this doesn't apply to PF members. They are unlike all the other Republicans supporting this criminal ]

Republican voters on Tuesday picked a conspiracy theorizing Arizona state representative to become their nominee to oversee the state’s elections. Mark Finchem (R) is one of the country’s most prominent Big Lie activists. He will now likely run against Adrian Fontes (D), the former Maricopa County recorder.

Finchem, a Trump endorsee and member of the Oath Keepers, is part of a wave of 2022 Republican candidates who’ve carried on the lie that the 2020 election was stolen, and who’ve promised to make sure things turn out differently next time around. Finchem has spent most of his campaign saying, in many different ways, that he wished he could have helped Trump steal a second term, and that he’d be willing to do so in the future.

Last May, Finchem wrote in a fundraising email, “I promise you this. If I was Secretary of State for Arizona in 2020, we would have won. Plain and simple.” He’s also introduced a resolution purporting to “decertify” the 2020 election results in three counties, a legal impossibility. The resolution was full of falsehoods about 2020 election statistics.
