You come home and find the door unlocked and you call the police because you are afraid a bugler could be there and they come and find no evidence of forced entry nor anyone in the house. The police then ask you to check for anything that may have been stolen and search as you will and find nothing missing then the police will give you a number to call if you find something missing. End of story. No matter how many times you claim something could have been stolen and demand an investigation until you find something actually missing they will take no further action beyond recommending that you be sure and keep your doors secured.

That is what is happening now. There are many theories that something was stolen during the elections and there have been several dozen attempts to get the courts to intervene but it is the same thing over and over, until Team Trump can show something is actually stolen the courts will respond with it's not their problem to fix but that you should make sure the system is better secured in the future.

It's long past time to stop going to the courts to fix what could or might have happened and accept that maybe there was no break in in the first place. Concentrate on how you can have a system that satisfies the worries of everyone in the future.

Good analogy for failing to establish a predicate. We can expand it to illustrate standing, as well.

Let's say your neighbor did see someone carry a TV out of your house and calls the police. Unless and until you press charges, the police cannot, and will not do anything.

Texas can't sue other states over their election laws. They are the neighbor who has no standing.

And lets be honest here. Investigations isn't what they want. They want Trump. Period. Democracy be damned. With Trump, investigations that don't result in a Trump win will just get everyone calling for an investigation into the investigators. And on and on and on. They are impervious to reason.

There is, however, no real comparison. In our case, we didn't find the door unlocked but rather we have the crazy guy next door telling us he saw a gang of Martians go in and set up invisible housekeeping and we really better burn the house down right away or else the Martians will take our job and seduce our daughter while putting a skorzaco truck up on blocks in our front yard.

Oh if Martians broke into my house, the crazy old man from across the road would talk them to death or to the point they took a phaser to him.

It's like the Steven Wright bit.

Of course it is false mind you, every one knows that when aliens abduct someone they leave a fake body behind. Those people are still alive on Trafalmador. How else could they fake the signatures?

That bit of wisdom might have been welcome in late 2016, and 2017, 2018, and 2019 ,,, but in late 2020 and early 2021 the best way to prove something was stolen after software designed by Hugo Chavez made the evidence go away is to apply the tools provided by the Founders and steal it back.

The weak analogy in the OP is more accurately expressed as:

You come home and find the door unlocked and half of your possessions missing. While you load the footage from the various cameras around the house, Police come and ask "so what exactly was taken?" You reply with a list of 100 missing items. The police respond with "well, do you have proof that those things were taken?" You reply "Here are the insurance pictures of what was taken." Police respond "Well, are you sure those things were taken and you didn't just misplace them? Maybe they are still here." "They are not here." At about this time, the videos finish loading, and amazingly, the exact same police sent to investigate were the ones who robbed the house. You start to load the video, and then the police stop you, with "but home videos aren't admissible in this investigation, do you have any actual proof that anything was stolen from you? BTW, we will take your videos now and if you find any actual proof, please call us at this number."

Let's say the cops look around and see a sign of forced entry but say they don't because they don't want to write a report?

Your analogy is wrong. The real comparison is that you find the door unlock. You prove it by showing

Except that it's not just that you are afraid that something was stolen, but rather that you have actual proof.

You have expert locksmiths prove that the door could be unlocked. You have statisticians show that statistically people whose houses weren't broken into don't file a police report, and that the ones who did have a much higher chance that their house was broken into. You have proof that the most likely burglars own shares in the company that make the locks. You have people testifying that they saw someone with a bag with a money sign tampering with the footages. You were able to use Pythagorean Theorem to prove without a doubt that your house was broken into. You have over a hundred Representatives who believe you. But the media will destroy you if you come forward with those claims.

If I came home and found my door locked I’d be suspicious. Very suspicious indeed.

Reading this thread l and other's like it I get a bad feeling that it's climate change for democracy. A tiny portion of scientists and investigator's opinion is accepted in the face of overwhelming evidence.

Actually, it's more along the lines of this.
Your standing on your lawn talking to the police, who ask if anything was missing.
You respond with "not at first glance. Nothing was askew."
At which point your neighbor comes over and tells you and the police, "I saw 4 men carry out a 75" TV and put it in their van."
At which point you look at him, then look at the police. Then back at your neighbor and respond, "I don't own a 75" TV."
To which you neighbor insists, that he saw 4 men carry a large tv out of your house.
To that, you look at the police and tell them you have 3 TV's. One in your living room. One in your bedroom. And one in your den. And all three of them are still there.

This is where we find ourselves. A lot of people saw a lot of thing.
But no one can find any actual proof or evidence of any of it.

I heard one of the Republican Senators,on Meet the Press, who is going to contest the elctoral count, state he heard where one witness saw where 42,000 people voted twice in Navada.
That seems like the sort of thing you could find proof of, somewhere.
