NOTE - Had to edit the thread title for space - Full Title = Confidential draft IRS memo says tax returns must be given to Congress unless president invokes executive privilege

    SNIP
Trump has refused to turn over his tax returns but has not invoked executive privilege. Treasury Secretary Steven Mnuchin has instead denied the returns by arguing there is no legislative purpose for demanding them.

The 10-page document says the law “does not allow the Secretary to exercise discretion in disclosing the information provided the statutory conditions are met” and directly rejects the reason Mnuchin has cited for withholding the information.

LOL... nice to know the department you supervise has your back, huh??

I have little doubt that Trump would sacrifice one of his children (Eric first) to keep his taxes hidden, so executive privilege could be coming soon, but this doesn't look good for the upcoming court battle from the Trump side. This memo will be Exhibit A in the court battle, along with the federal law stating "shall furnish". Trumps main legal defense will be "Try and Stop me"...

Everybody, even the RW, knows that Mnuchin doesn't have a legal leg to stand on here, but continue to back this obstruction because........ Orange Man Good?

Off to the courts, where Trump is currently 0-1...

Since calling Trump a pig, racist, sexist, bigot and everything else in the book, didn't work to prevent him from becoming president, they had to move to something else. Russia, vote tampering and spygate. After that didn't work, they moved to simple collusion and obstruction into charges he's not even guilty of. And now that that has no legs, they're just going after his finances....because....WHY NOT? Just because they "think" or "suspect" he might be compromised, thats reason enough. No proof or anything. But they all have a "feeeeeeeeling" he did something wrong.

Well, well, well. In that case, we need to open up EVERY congresspersons finances since they were a child, because we can suspect they're ALL compromised. The CLinton foundation received millions from foreign entities and the CLintons not surprisingly helped all those entities. So, by Liberal logic, they must be compromised. Too little too late obviously, but we can easily go after Pelosi and open up her books, "just because".

Its truly incredible witnessing Democrats literally tossing the kitchen sink, figuring that they have to find something and will find something if they dig deep enough and long enough. And I have no doubt they could find something that could be impeachable, since there's not a "billionaire" alive that hasn't cheated in their life.

**** doing their jobs. **** the people that elected them. **** trying to to accomplish anything at all. Nope. Their entire goal is ORANGE MAN BAD. Impeach!!! And we're paying them, why again?

LOL... did you READ the article and understand the gist of it?? Apparently not. The IRS letter doesn't even mention Trump and the article barely does.

This smears Mnuchin and his obviously illegal efforts to protect Trump.

Try and understand that not everything posted on here is directed at Trump... there are plenty of others in this shitshow of an administration worthy of contempt, in every meaning of that word...

Quoting from your OP "“does not allow the Secretary to exercise discretion in disclosing the information provided the statutory conditions are met”

The Sec of Tres obviously doesn't believe the statutory conditions are met because the House has yet to highlight the legislative purpose. Hence why he has taken it to Court...nothing "illegal" about exercising ones right to be heard in Court.

[T]he Secretary’s obligation to disclose return and return information would not be affected by the failure of a tax writing committee . . . to state a reason for the request,” it says. It adds that the “only basis the agency’s refusal to comply with a committee’s subpoena would be the invocation of the doctrine of executive privilege.”
    ENDSNIP

Also, what does that mean, "Hence why he has taken it to Court"?? Mnuchin has done nothing in the courts, just said that he expects it will end up there, which it will...

Trump has no claim of executive privilege on this. It is only applicable to national security matters, or the conduct of certain ongoing matters of government.

So, unless discussion of Trump's financial records does involved revealing how heavily dependent his businesses are on Russian money, there is no basis for such a claim.

    Nixon tried it too......and failed.

yeah he has...he moved to quash the subpeona...it's on appeal at the moment...but the lower Court when ruling against him did highlight in her opinion that the Dems had to have a legislative purpose.

At this point, the Sec still doesn't believe the requirements have been met, as you pointed out in the OP...the case is still pending. If it loses at the DC Circuit, it will go the SCOTUS...if he loses there...the President can use EP.

The courts will decide that no? If they decide that an congressional committee can go after tax returns, business records and bank records for 10 years before he even ran then it will be a scary day in America. What that will open up is that a political party can go after political opposition by obtaining these records moving forward. I don't want the republicans looking at Bidens tax returns because he has some shady stuff back in the day with Ukraine. That stuff is for the prosecutors and FBI to do. Can you imagine the pandora's box this will open and how bad the political process will be? Surely you don't think if the dems get this stuff that the republicans won't do the same thing?

Nixon didn't use EP for his tax returns.

    EP deals with communications...

Also Trump has released his Fin records, they are public and have been...he's released them yearly since he filed them with the FEC in 2015. Here is the most recent one https://www.documentcloud.org/documents/4464412-Trump-Donald-J-2018Annual278.html

If a democratic president doesn't release his taxes and there is reasonable suspicion about them, go for it...

I don't believe any other current or future candidates will be able to proceed very far in the process without releasing their taxes anyway, so I don't expect this fight to happen in the future..

Don't be obtuse, they are asking for his business records, banking records and tax returns for 10 years prior to running. That's way different than a 2015 tax return and you know it. If he ends up being forced to do this, than you can bet the dems 2020 candidate and every one moving forward will be getting the same subpoena . Can you imagine how many good qualified people will never run because of this. The opposing side will spin every little thing that's completely legal as corrupt. Dangerous time for America.

Ha Ha I can't believe that wacko libs haven't heard. They promised collusion and conspiracy, they screamed it daily, they got the investigation, got the guy they wanted, and he concluded there was NONE. Now we all see we're moving the goal posts and it's a joke.

I honestly dunno what you're hoping to find in Trump's financial accounts that IRS has not yet found, and not axed Trump to respond to. I'll tell you more - whatever discrepancies or gray areas there may be, Trump has known about them for a long time - he's been audited forever, and he has dealt with them I'm sure.

Resistance to Trump is futile, my friend. You' been had :nana:

I have no clue what could be found in Trump's tax returns, not being a tax expert (if you've seen my taxes), but if the chairman of the House Ways and Means thinks there is value (legislative or oversight) in getting these documents, I'm OK with that..

Maybe there's nothing in there... I dunno, but that's not the point, is it? I'm not falling for that crappy argument....

Not to mention he has the law on his side with the actual request...

And we've all be "had"... just those of us that didn't vote for Trump knew it at the time of the election..
