Just putting on a Rowan County taxpayer's shoes and walking for a second, I sure wouldn't be happy about it. I'm not sure how far away the next election is though. Out of sight, out of mind, might come into play before then.
Nothing prevents her from firing anyone on staff nor was she ordered not to do so. Personally, an employee stating they will defy their boss is grounds for discharge on its face. The federal judge neither ordered nor authorized the employees to issue marriage licenses and firing them would not be a violation of the order of the court, other than the judge doesn't care about due process or law. She just couldn't try to stop unauthorized persons from issuing marriage licenses to not violate his order. Firing them doesn't stop them from issuing licenses, which they are doing with no authority to do so anyway. She could even provide a chair and table in the hallway for discharged employees to continue to issue marriage licenses under their non-legal authority. Even the judge said he didn't know if the licenses they were issuing were valid.
Firing him wouldn't be telling him to stop. It would be firing him. He could stand or sit in the hallway handing out marriage licenses.
She would have to switch from being a Democrat to a Republican. Many Democrats agree that a judge is greater than God and that everyone should swear to this under oath.
