Diplomats are not subject to the jurisdiction of the United States (U.S. law doesn't apply to them) for that reason, their children are not natural born American citizens. The issue is the status of her parents at the time of her birth. If they were still diplomats, she is not a citizen.

WASHINGTON — An Alabama woman who joined the Islamic State has lost the first round in her legal fight to return to the U.S. with her toddler son.


A federal judge in Washington denied a request to consider Hoda Muthana’s case on an emergency basis. That means she won’t be able to immediately leave a refugee camp in Syria and fight her citizenship claim inside the U.S.

But Judge Reggie Walton did say the 24-year-old woman’s lawyer made a “valid argument” for her right to citizenship during a hearing Monday.

The U.S. says Muthana is not a citizen because her father was a Yemeni diplomat at the time of her birth in New Jersey. Her lawyers argue he was no longer a diplomat at the time. A ruling could come this summer.

Daddy quit his post in one month before she was born and U.N. records vary a bit beyond.

 

Dad was still here under a diplomatic visa and the State Department wasn't notified that he was no longer in that position until after her birth. That means he retained all the immunities of a diplomat after her birth.

Therefore not a citizen.

 

Hopefully she'll be the target of a GBU real soon.

She left of her own volition, as a legal adult. She shouldn't be allowed back, it doesn't appear she committed any crimes against the US, but she made her choice to stand against the US...

“ISIS bride” Hoda Muthana is not a US citizen — and America is under no obligation to let her back into the country, a federal judge ruled Thursday.

Judge Reggie Walton found there was enough evidence to prove Muthana — the US-born mom who fled her home in Alabama to join the terror group in Syria in 2014 but has been begging to come back to the US — was born while her father was a Yemeni diplomat, BuzzFeed News reported.
