    Deport them with no hearing or just with no representation at the hearing?
    Someone accused of being here illegally has a constitutional right to counsel. Just as you would.

    The sixth refers to criminal prosecution. Deportation isn't criminal prosecution.

    The sixth amendment talks about criminal offenses. Deportation is not a criminal punishment.

    Yes but deportation it's not a punishment it isn't a fine and it isn't incarceration. know if it wanted to find them or incarcerate them that would be different. but returning them to their home country is what I would call a favor.

    Doesn't have to be. The 6th amendment still applies. It's why they have a hearing.

    what you call it has no relevance to constitutional law. All person inside US borders are under US jurisdiction, and have constitutional protections. Their immigration status is irrelevant.

    Deportation does not require a criminal conviction.

    didn't say it did. I pointed out the constitution requires they have a hearing, and be given legal counsel.

    if they were being prosecuted for a criminal the sixth amendment would apply they're just being returned to their home country. There would be no need for a hearing.


    only in a criminal prosecution. Deporting non-citizens is not a criminal prosecution.

    again deportations are not a criminal prosecution. So the 6th amendment doesn't apply.

    You bring up a good point and I think it's the major reason why nothing will ever really be done about the illegal aliens. Both Democrats and Republicans want there to be illegal aliens. Because if you are a gardener or made you don't want to pay them what you would pay an American to do that. It's essentially a built-in under class. It's kind of messed up if you think about it.
