    ACB was a direct correlation to the BS the Turtle gave as his reasoning for Gorsuch.... without that, ACB was perfectly OK to ram through American gullets...

    I am so torn by this. We are increasingly pressuring some of our finest justices off the court based on the timing of election cycles. This man is still a towering intellect, and great student of the law and a servant of the constitution and our country. Its agism, and it feels dirty. But what else can we do with Mitch McConnell and this hyper-partisan environment surrounding every aspect of the Senate? It is the 'right' decision if we are to keep any semblance of balance on that court but its going to be very hard to come up with as capable, as learned, and as decent a justice as Stephen Breyer! He's a giant on that court.

    Now THAT is actually a very relevant observation.

    IF (Repeat IF) that were to happen--Biden would have to (already) have the Exact Person in mind.
    (And, as of now, nobody really stands out who can fill the bill. Unless it is someone completely out of nowhere).

    I think Brown (who has been rumored) is too old at 51.
    When Thomas was apponited he was 43.

    I would favor an Extreme Left Winger.
    So far Left on the Judicial Spectrum that they make Clarence Thomas look like RBG.
    Preferably in their Late-30s.

    Obviously, Breyer's Retirement is too little/too late to save the Court.
    RBG should have retired during Obama's Tenure.
    All this does is prevent the Court going to a 7-2 Cons. Majority in the future.

    Barrent replacing Ginsburg assured that the Court will he lost for decades to a Cons. Majority

    Well some people view politics through their emotions, so I can see why you would think that the only POSSIBLE reason someone would suggest that Harris in the SC slot would be beneficial for party prospects is because of "nastiness and resentment."

    To me, I see Harris as a political problem for the Democrats and nominating her to the Supreme Court takes care of that problem in a way that would cause the least amount of backlash.

    Which he did in response to Reid nuking the filibuster to push through lower bench appointments. Plus the argument of not letting the guy on his way out the door, who no longer represents the country, seat the bench is a sound one. The far-left progressive ideology was on its way out then, its still on its way out now. I say block the far-left's nominee and keep it blocked until 2024. Now if by some reason Joe doesn't succumb to the Marxists that run his White House and gives us a Constitutional judge then I can change my position.

    Well they'd need Joe or Kyrsten of course to avoid hitting 51 so its a longshot but maybe some dealing can be done.

    Wasn't much of any indication Trump was going to lose. When Barrett was sworn in Joe had been in hiding for about 20 days.

    Gorsuch, Kavanaugh, and Barrett got a combined total of 4 votes from Democrat Senators. Half of those were from Joe Manchin alone. All three justices received a "well-qualified" rating from the ABA. Do you think that level of opposition tracks with Democrat Senators giving nominees fair-minded consideration?

    RBG thought that she would be able to retire under a Hillary Clinton administration, giving Hillary the opportunity to pick a Supreme Court Judge (IMHO). She gambled and lost on that.

    Breyer has been badgered by leftists to retire to avoid the same sort of situation.

    Progressives Want Justice Stephen Breyer To Retire. His Response? Not Yet

    So I imagine either there was a change in his health or he was worried about the political tea leaves and saw this as an opportunity to retire when he could be replaced by an ideological equivalent.

    Gosh golly gee, reading this thread you would think that Democrats are somehow not allowed to nominate and confirm justices to the Supreme court.

    Did I miss some law getting passed ?

    As for Breyer's replacement, I hope it's someone to the left of Bernie Sanders, if only to restore a little balance and make conservative heads explode.
