    I don't see how the justices can possibly validate the religious discrimination claims in October, because the only people whom the ban can affect are people who are outside the USA and who do NOT have a bona fide family relationship with a USC or employer. Persons outside the USA are not generally protected by the Constitution.

    I'd be embarrassed if I had been running my mouth against the President on the ban. Not even Justice Ginsburg, who hates Trump, or the Wise Latina voted against lifting the injunction.

    It's interesting that most cases involving injunctive relief do not lead to permanent injunctions, because the parties usually settle if a preliminary injunction is imposed. Looks like this case will die on the vine as moot, I mean before the merits are reached, as the adminstration will have new vetting procedures and drop the blanket ban by the date in October when the Supremes take it up.

    I think the answer is that it will take regulation and drafting of Operating Instructions, and in turn a public comment period. Takes time.

    Court to Trump: Go ahead and protect the borders

    The Supreme Court showed it still has enough sane members to preserve our democratic republic.

    The court rejected the crackpot theory that there is some sort of right to come to America no matter how likely it is that you may blow things up.

    The court upheld President Trump's executive order imposing a moratorium on travel from six mostly war-torn countries.

    Obviously governments under duress often cannot fully vet the people they give passports to.

    Trump has a nation to protect.

    The Supreme Court is letting the Trump administration enforce its 90-day ban on travelers from six mostly Muslim countries, overturning lower court orders that blocked it.The court did leave one category of foreigners protected, those "with a credible claim of a bona fide relationship with a person or entity in the United States," the court said in an unsigned opinion. The justices will hear arguments in the case in October.The action Monday is a victory for President Donald Trump in the biggest legal controversy of his young presidency.Trump said last week that the ban would take effect 72 hours being cleared by courts.Frankly, I want the judges to stop the ability of some Obama-appointed, radicalized judge in Hawaii to arbitrarily halt a president on national security.

    But then again, I believe in checks and balances, which we do not have on the judiciary.

    This is a temporary victory in a game we should not be playing.

    By the way, the moratorium should be over by the time they hear the case.

    They can read calendars.

    They also can read newspapers, and I doubt they want to accept responsibility for any calamity caused by a constitutionally shady argument that there is a right to a visa.

    Personally, I would not play this hand this way. I'd keep my hole cards hidden and play the river. If things are looking just right, I'd extend the ban another 12 months. Then another 12, and another. :banana:

    MODERATORS EXPLANATION

    The OP was linked to an AP website which handles the archival of articles in a very different fashion than other news sources. To begin with, all AP titles are in all caps. Rule 11 requires the OP to cut and paste the title of the link, which means the title of the thread will be in all caps in order to be in compliance with Rule 11. Typing in all caps is pretty rude in most internet circles and is akin to yelling and it can be considered flamebaiting. Most mods will not give an infraction for all caps, we simply ask that you stop doing this so everyone on the internets won't automatically hate you.

    The second problem with the AP news source as a site is that they move links around, especially the hottest items of the day. You can have a working link at 9 AM, and it won't work be 10 AM, only to start working again at 11. This makes it pretty frustrating for posters who actually read the link before forming an opinion. If you are patient and look around the AP website, it is usually a pretty easy task to find the article the OP is referring to.

    The news story was also an extremely important story and the positive value of keeping it open for discussion far outweighed the Rule 11 problems which the author may or may not have been aware of. For these reasons, the thread was not closed and the title was not edited.

    does the president need a public comment period to change regulations? Seems neither the republican house or senate seem to require public comment and hearings to pass legislations these days, so can't see the prez needing it.

    The ban was originally only 90 days, which are long past. Yet the ban has now been approved. Would Trump not be able to reasonably argue for a permanent implementation at this point? It's not like the people in question are any use to the USA.

    My own dear countryman, brother of the former leader of the Labour Party and son of arch Marxist Ralph Milliband, is unhappy.


    I hope Mr Trump pays the offended Mr Milliband due attention. Then he can tell him to **** off.

    I'm just going to say 1 thing.

    If the 9th Circus strikes something down, it's almost a guarantee it's going to be overturned.

    I believe almost 90% of 9th Circus cases that are heard by SCOTUS are overturned. All other hover at around 60%.

    Legally, maybe (the court hasn't reached the merits of the claim, specious in my view, that the ban violates the free exercise clause), but politically, no. He's on record as just wanting a pause.

    These "lies" of Trump are what is known as "puffing." Every promoter does it and we all forgive them because we know deep down that we are all of us puffers to some extent.
