The 1st amendment? No...don't think that has anything to do with the Electoral College. Any change to the 1st or 2nd amendments or the Electoral college would require amendments to the Constitution and is, therefore unlikely to happen.
I don't know about the election of 2000 or 2016. Representatives are awarded to each state based on the population. We have 435 representatives, all with fairly equal number of people in each of the 435 districts. Each has approximately 711,000 people with the exception of a couple of small states which the constitution guarantees one representative. So 435 out of the 538 are population based. what isn't is the 2 electoral votes given for each senator and DC's 3 electoral votes. The electoral college is a combination of being both population and state based. After all we are a union of the several states. You probably right about 2000, Bush won 30 states to Gore's 20. Without the 2 electoral votes for each senators, it would have been Gore 222 to Bush's 211. You had an unfaithful electoral. 2016, again saw Trump win 30 states to Clinton's 20. Without the 2 electoral votes for each senator the final result would have been Trump 244, Clinton 185. The rest were unfaithful electors. Even with the electoral college being purely population based, Trump still would have won as he squeaked by in Pennsylvania, Michigan and Wisconsin. I also had to subtract 2 for DC leaving DC with just one electoral vote instead of three.
I was under the impression that 38 states would have to agree to that, and additionally under the impression that 38 states would most definitely not agree to that. perhaps i'm wrong.

My previous post was incorrect. In 2000, proportional state allocation - Bush picks up electoral votes. In 2016, it breaks 256-250 for Hillary - which is a win for Trump.
