Do you see a problem with my solution that I'm not seeing?

If you are referring to #83, just booting them out, I would personally favor it, however the current administrative, legal, political, and media environment would be totally opposed to it. In an era in which virtually every Democratic candidate came out in support of free healthcare for illegals, it's unlikely reason will prevail in regards to our borders.

Well my whole idea is to decriminalise non-port of entry border crossings so that they don't need to remain in the country to face the justice system.

They aren't. If there's no opportunity to question a low-level official's decision to deport an individual, it's inevitable we'll end up making egregious mistakes like deporting U.S. citizens.

They're not remaining in country because they are waiting on a fine. They are arguing that they should remain in the country and that kicks up an entire process.

I cannot see how you can say that it is inevitable that deporting ILLEGAL ALIENS will lead to deporting CITIZENS OF THE US! That truly is just crazy talk! Are you saying that a "low-level official" could wind up deporting a citizen without a change in law? Wouldn't the Constitution have one or two things to say about deporting CITIZENS? :roflol:

These are not people claiming asylum, that's an entirely different process. They just don't want to leave.

Well then they have no argument for why they should remain in the country, right?

You're full of it. Citizens have been deported even with safeguards in place.
    They already have.
Why do you think people being deprived of their rights is a big laugh?

Multiple lawyers and an entire political party disagree.

Well on what basis do they argue if not asylum? You can't honestly be saying that some people who arrive illegally and who are not eligible for asylum, are allowed to remain in the US and go onto become citizens. This would mean that the US is an even bigger JOKE than I thought on immigration matters.

They may not become citizens, but they never leave and their kids of course are citizens.

So then on what basis were they allowed to stay if not asylum?

No, Americans have been deported even with the court review procedures we have in place.

    From the cite:

"The following is an incomplete list of Americans who have actually experienced deportation from the United States:
    • Pedro Guzman, born in the State of California, was physically deported from the United States in 2007 but returned several months later by crossing the border. He was finally compensated in 2010 by receiving $350,000 from the government.
    • Mark Daniel Lyttle, born in the State of North Carolina, was physically deported from the United States but later returned and filed a money damages lawsuit in federal court, which he ultimately won.
    • Andres Robles Gonzalez, derived U.S. citizenship through his American father before being deported. He was returned to the United States and filed a money damages lawsuit in federal court, which he ultimately won.
    • Emilio Blas Olivo, born in Weslaco, Texas."
