Default Judges: Guantanamo prisoners can't challenge detention

WASHINGTON: In a victory for President George W. Bush, a divided federal appeals court ruled that Guantanamo Bay detainees cannot use the U.S. court system to challenge their indefinite imprisonment. A Supreme Court appeal was promised.

Tuesday's 2-1 decision by the U.S. Court of Appeals for the D.C. Circuit dismisses hundreds of cases filed by foreign-born detainees in federal court and also threatens to strip away court access to millions of lawful permanent residents currently in the United States.

It upholds a key provision of the Military Commissions Act, which Bush pushed through Congress last year to set up a Defense Department system to prosecute terrorism suspects. Now, detainees must prove to three-officer military panels that they do not pose a terror threat...

Whatever you want to call them, they are enemy soldiers, which have been by long custom, practice, and law been held during hostilities. This nonsense shouldn't have gotten this far.

They shouldn't go through the U.S. court system, but they shouldn't be denied the rights of habeas corpus.

BTW, if Guantanamo prisoners are really enemy soldiers dangerous to America, then why have 340 been released? I'm serious: http://www.msnbc.msn.com/id/15361740/

Becuase thye go through a process and if deemd to no longer be a seriosu threat(like many simpe Taliban soldier types) they get release..out of that a very small number have gone right back to Terrorism and fighting US forces.

Whats left at Guantanamo now is mostly hardcore fanatics.

Default This is a no brainer - no cause for celebration

Those who celebrate have not been following this story. The Administration chose Guantanamo precisely because it is NOT on American soil, in a country where we do not have diplomatic relations, and on a long standing military base. In other words, the one place where terrorists are put in a judicial "black hole". US courts do not have jurisdiction in Cuba or in Guantanamo or on a military base. The prisoners are locked into the one area where NO ONE can get at them, except the Supreme Court.

That is the reason why all case law concerning the prisoners in Guantanamo has come out of the Supreme Court. The is the ONLY court that can assume any jurisdiction. The Court of Appeals has no jurisdiction and should rightly turn down any request to even look at the issue.

Illegal aliens are in a completely different situation. They are in the US, and subject to US laws, just like you would be subject to Mexican law if you don't have a legal visa to be there.
