He was a legal US citizen picked up in the US so this ruling makes sense to me.

The judge didn't say he should be set free. So, I'm fine with the ruling. Put him in the civilian courts, charge him, and try him. The only negative thing about that is that the court proceedings will be public and any information pertaining to his connection with al Qaeda will become known to the enemy as well as everyone else. But having al Qaeda contacts on his laptop will most likely at least give him some prison time and get him out of circulation for a while.

Just to set the record straight, this guy isn't a US citizen, he's a legal resident -- a citizen of Qatar in the US on a student visa. The question is not whether we can detain US citizens as "enemy combatants" but foreign civilians (like the guys who flew the planes).
