Default Johnson & Johnson sues the Red Cross

http://www.nytimes.com/2007/08/09/bu...b36&ei=5087%0A

Now those humanitarian bastards want to put their own logo on first aid kits they sell to support their non-profit business. Can't let that happen!!!!! [/endsarcasm]

apparently Johnson & Johnson has been using the red cross symbol for marketing since 1887...

Quote:
From time to time, the American Red Cross sold products bearing the symbol as fund-raising efforts. Jeffrey J. Leebaw, a spokesman for Johnson & Johnson, said the company had no objection to that.

But in 2004, the American Red Cross began licensing the symbol to commercial partners selling products at retail establishments. According to the lawsuit, those products include humidifiers, medical examination gloves, nail clippers, combs and toothbrushes.
....

Quote:
Mr. Crisan said it was not clear how far the American Red Cross wanted to go in licensing the symbol for commercial purposes, noting that the red cross was a trademark of Johnson & Johnson before the American Red Cross was officially chartered. Mr. Crisan said that some of the items being sold under licensing agreements by the American Red Cross seemed to compete directly with products sold by J.& J
I find the whole thing stupid to begin with.

That said I wonder what article you read.....

Default z

Make it real simple...
J&J had trademarked the symbol before the Red Cross came about.
It had an amicable agreement on its use with the Red Cross for all intents for 100+ years.
The Red Cross has gone beyond that in their actions and is now J&J is sayig uh excuse us ut sellign things in stores uder our trademark is a lil much.

What you implied has little to nothing to do with what is stated in the article.

Default J & J is right

If a venerable organization such as the Red Cross is going to dabble in capitalism, and make incursions in the retail sector, they should realize beforehand that they have to obey the law pertaining to commercial trademarks. Sounds like Mr. Everson is getting too big for his britches.

Not surprising that the New York Trash would print an article biased toward the Red Cross, as they seem to be against large corporations making a profit...with the exception of themselves, of course.

Default even non profits have no right to infringe upon the rights o

Agree with MRMAGQQ that even non profits have no right to infringe upon the rights of anyone or any entity. All laws should be followed including trademarks laws, intellectual property, etc. No exception can be granted by other than the rightfull owner of the property.
