The Confederate flag is a symbol of treason, secession, racism, and slavery. If a state or local government wishes to fly the darn thing, they ought to have the decency to secede first.

Yes, because in the modern age for most people in the South it is a symbol of pride in their regional birth. Symbols meanings change over time. If people want to debate what the star and bars means that is another issue.
Furthermore its a matter for the local and state government's and the people who are residents of those states and counties to decide. I'm not a southerner, wasn't born there and I don't live there, the issue doesn't mean much to me as the issue itself. What does matter to me is the issue of federalism, and this is one of those issues. Let the people of the county/state decide everyone else shouldn't bother with it nor care about it.

Im sure Sadaam's Ba'ath party had a nice little emblem that they get all gushy and nostagic about...'pride'.

I don't think it should be illegal if that's what you mean. If a state decides it wants to hold itself up for ridicule and get the title of racist backwater that's up to it. In the end I don't think too many people's lives are going to be affected by what a piece of cloth looks like.
