I'm not debating that.
That's why it should be taken into account in sentencing. Hell, I'd be fine with him getting a very minimal manslaughter charge (just parole).
But still we should not encourage vigilanteism.

There's one factor that could change my mind... Did the man appear to be still threatening his wife at the time? Then it is self defense.
But shooting someone who is running away... That's vigilanteism, not self defense.
Deserved or not (for the very reason this case illustrates. The man who was killed was wrongly killed).

I was thinking the same. The man who ran away did not pose any threat or danger to neither the wife nor the husband.
The husband acted out of pure rage. The wife acted maybe out of fear of her husband. What she did was very wrong. That four letter word caused huge problems.

For me it wouldn't be about self-defense. And if vigilanteism is what you want to call it, that's fine with me. But I'd be making (*)(*)(*)(*) sure the rapist would never commit that crime again....EVER.

The real shame here is like I've already said. The husband now has to live with the fact that he's taken the life of an innocent man. Knowing the burden I'd place on my heart for this, I'd think it could be punishment enough.

Hitting someone (accidently) with your car and killing the man that just raped your wife aren't equatible in my mind.
