In short, no.

While I do not approve of many of the actions of the Bush administration, they were careful to not put themselves in a position where they did not legally cover their rears.

Additionally, if we are going to start prosecuting presidents for things done while in office that were not quite illegal but that we did not like, then we might as well become a dictatorship.

According to obligations to UN treaties
The U.S. should investigate torture "allegations"
and prosecute those responsible.

The Bush/Cheney orginazation may have crossed the line
of what is legal.
