When considered logically marriage is nothing more than a personal/business partnership between individuals and overwhelmingly is controlled by contract law (as it should be). Divorce is predominately a division of assets and liabilities (yes, children can be considered as both an asset and liability of the partnership).

The government should not be involved at all except when a dispute arises and those disputes should be resolved under contract law. There should be no government involvement in the forming of the partnership and the courts should only become involved if there is a dispute during dissolution of the partnership. The sex of the individuals involved in the partnership and the number of individuals involved in the partnership should not be an issue of government control. The right of forming personal partnerships should be protected under the 9th Amendment to the US Constitution and I find all marriage laws to be in violation of the US Constitution.
