Because of concerns about who might get labeled a sex offender. 25 years hard time is a pretty harsh sentence to receive on a technicality.

I have a general issue with mandatory minimum sentencing for exactly such reasons. Every case is different; they shouldn't be treated as cookie cutters.

Why do conservatives and Harley goons claim to back this law, but then trash anyone attempting to author "hate-crime" bills? There's no difference.
