Default How would I like to change the Constitution?

For one, limit the power of the Federal Government. The articles of Confederation was a system that was too weak, our current government gives the national government too much power. We need to alter it. The constitution was NOT a democratically created government. The framers were not selected directly by the people. We need a new government that gives less power to the national government and one that is more democratic. We should get rid of the electoral college, have a way to counter decisions by the supreme court, have more direct representation in the form of referendums, and make election day a national holiday to make sure that EVERYONE votes.

Default Actually.....

The Federal Government has taken on a lot of Non-Constitutional responsibilities (Social Security, Education, Welfare,........) and all that could be simply legislated away at any moment if there was a will to do so.

I like the idea of getting rid of the electoral college a lot. It simply causes too many people to not be represented (California/New York Republicans and Southern Democrats)

The way to counter the Supreme Court is with Constitutional Amendments

A national holiday for voting could be legislated into reality at any moment

Default Uh, no offense

but if you really want to talk about revising the Constitution, first you should learn it. And in our society, that means you start with reading it. But that is only the start. You don't know what it says until you read the case law that interprets it. Seriously.

To those of us who have, threads like this are a a circus of ignorance...like children dressing up their barbies to play adults...

Default OK.....

Then feel free to chime in with some worthwhile comments.

In all honesty, I have really enjoyed this thread and learned a lot from it. I'll admit I had some misconceptions but PJO34 really brought some good things to light which have increased my understanding of The Constitution.

:P

We're all ready to be dazzled by your hidden insight.......

Default You want insight?

OK, get off your butt and go buy Lawrence Tribe's treatise on Con Law. If you are truly interested in it, you will find it fascinating. I don't mean to be condescending, but if you aren't somewhat familiar with the case law interpreting the constitution then it would be like having beavis and butthead debate string theory and quantum mechanics...

I think the case of Marbury v. Madison is a good start...

Default LOL Wrong Thread

This isn't about case law interpreting The Constitution it's about amending The Constitution which trumps legal precedent.

You can debate the "Gray Areas" via the legal system as much as you want. I'd say a much better approach is to amend The Constitution for clarity and effectively represent the will of the people.

Why use a Beavis and Butthead metaphor? I'm an aircraft mechanic interested in debating the pros and cons of The Constitution and not a legal expert and that's the beauty of Democracy. The Constitution is a public document and something people should really take a lot more interest in.

Don't expect me to ride on any aircraft you've been working on.

Default uh

once again, the case law interprets the constitution...in particular Marbury v. Madison answers some of the questions you raised in this thread...I won't tell you which ones though...

Catholic schools make religious days of obligation holidays so all the kids go to church and most don't. I believe the same would be true for an election day holiday.

Default Thanks.......

http://www.nv.cc.va.us/home/nvsageh/...t3/Marbury.htm

That was an interesting site about Marbury vs. Madison

There are some really weird things about the American social fabric. If it was a Circus, politics would be a pack of monkeys screwing a football and the legal system is the magic act.

This is what has my head spinning......

OK The Supreme Court makes it's own ruling about itself being the ultimate authority in determining the "Constitutionality" of the laws passed by Congress and signed by the President and everyone just accepts this......?????

LOL Talk about Jedi Mind Tricks

OK So, MvM really seems to focus on the Supreme Court as having this power so, did the rest of the Courts in the Federal Judicial System also receive this power through association?

Hans you are basically dropping bombs. What do you suggest we do about limiting the government. If you had the opportunity to change something specific about the constitution which would achieve that end, what would you change?
