Default GOP versus Judges

http://www.washingtonpost.com/wp-dyn...-2005Apr8.html

So basically *beep* the constitution, if you don't obey the arbitrary "religious" values, you'll be vilified.

What we learned from the Schiavo mess

1) Jeb Bush, George W. Bush, and Tom Delay are all world renowned neurologists.

2) 22 successive court battles that all ended in exactly the same way means there is something wrong with the courts, not the Schindler's case.

3) Mike is after money which is why he turned down 1 million dollars and 10 million dollars to sign over guardianship.

4) Congress and the State Legislature of Florida has nothing better to do than pry into the private medical affairs of others.

5) Pulling life support is bad in Florida when authorized by the legal next-of-kin, but pulling life support is good in Texas
when you run out of money and the mother pleads not to pull the plug on her baby.

6) Medical diagnoses are best performed by watching highly edited videotape made by Randall Terry rather than in person by trained physicians.

7) Minimum wage making nursing assistants are more qualified to diagnose a persistent vegetative state than experienced neurologists.

8 ) Cerebral spinal fluid is a magical potion that can mimic the entire functions of a missing cerebral cortex.

9) 15 years in the same persistent state is not really enough time to make an accurate diagnosis.

10) A feeding tube that infuses yellow nutritional goop is not really "life support".

11) Jesus was wrong when he said that a man and woman should leave their parents and cleave only to each other.

12) Marriage is the most sacred of all unions, except when it isn't.

13) Interfering in a family's private tragedy is a great reason to cut short a vacation, but getting a memothat warns a known terrorist is determine to strike inside the US is cause to relax and finish up some R&R.

14) Pro-lifers are really compassionate people which is why they are hoping that Michael Schiavo dies a horrible painful death.

15) The Supreme Court of the United States and the State Supreme Court of Florida mean "Maybe" when they are saying "No!".

16) Supreme Court Justice Antonin Scalia is a bleeding heart liberal.

17) 7 Supreme Court Justices were appointed by republican presidents, so it's Clinton's fault.

18 ) A judge who makes rulings based on the law is obviously an atheist, liberal, democratic activist
even though he is a conservative, republican, Southern Baptist.

Default ....

I think you may find that we have exhausted this subject.

But I will say this. All of the things you mentioned had little to do with my own opinion in this case. For the most part, I based my opinion on the videos and the Golden Rule. I think most people did.

I disagree. I think most people used this unfortunate event to advance their political, moral, and societal beliefs. I believe it showed the moderate people in this country exactly how out of touch with reality the religious right happens to be. There are at least two main types of religious people in this country: (1) the 12thMan type, and the (2) GOPer type.

The GOPer type has the government right now and I hope this unfortunate event will help change that in the next election.

I think this illustrates how evangelical Republicans are actually closet cannibals. They find a reason to yell and scream, and then thy eat their own

Default Still...

Even though Michael's case was correct, and 22 successive courts, the majority of them conservative, backed him up, I feel a little guilty for jumping up and down and shouting, "Just die already!"

Default Oh please...

Of course, the simple fact that a Conservative has been outspoken against such the oligarchy that is are Judiciary system most mean that this is a new standard right? OF course this is the Jacobin (and the biggest defender of the oligarchy PJO34, who I don't consider a Jacobin cause he dose actually have a brain and from time to time uses something more then just pure reasoning and emotion) belief. The fact is that, this is a very valid American tradition that has been going on for centuries. The Supreme Court and other smaller courts have always started to abuse the power over time, and the public has fought back. Thomas Jefferson, James Madison, John F Kennedy, Lyndon Johnson, George H. W. Bush as well as many others in the nations past have called for a extreme wreaking of this almost absolute power branch of are government. All of them have argued for term limits. Know personally I consider Johnson one of the biggest Jacobin's that has ever held the presidency but of course Modern Jacobin's would disagree I guess. The genius statesman Jefferson has written...

Quote:
"For the safety of society, we commit honest maniacs to Bedlam, so judges should be withdrawn from their bench, whose erroneous biases are leading us to dissolution. It may indeed injure them in fame or in fortune; but it saves the Republic, which is the first and supreme law"
The fact is, is that the very idea of judicial supremacy smack's write in the face of the intentions of the founders. The entire bases of it gose back to a political show down between a Federalist and a Republican. The federalist Chief Justice John Marshall (former Secretary of State under John Adam, until March 4th 1801). the Republican (or to be PC Democratic-Republicain) Thomas Jefferson president on the United States. The bad blood began with Jefferson's ordering that all editors and writers convicted under the Sedition Laws freed from prison and ordered a end of all prosecutions. (The Alien and Sedition Law smacking right in the face of the First Amendment anyways.) With the help of the Republican controlled congress Jefferson stopped the law and changed it. This enraged Marshall (a staunch Federalist and one of the driving forces behind the Alien and Sedition acts) to no end. The bad blood between Jefferson and Marshall lasted till there death. With the courts backed earlier with Federalist (by the Lame Duck Adam's administration along with the then Federalist, congress) Marshall made his moves. Knowing Jefferson's unwillingness to accept the 25 to 42 commissions Jefferson ordered Madison (his secretary of state) and ordered him not to deliver the Marbury commission. Marshall then made his move, with the court case of Marbury vs Madison. Marshall twisting the Constitution around in order to use a act that dosen't even exist in the Constitution (or as Jefferson again warned people bending the Constitution like a ball of wax) Marshall simply said....

Quote:
"A legislative act contrary to the Constitution is not law."
Of course Jefferson howled over there saying among other things.....

Quote:
"No branch has absolute or final authority to control the others, especially an unelected judiciary."
This idea wasn't only held by Republican either federalist themselves where against such power concentrated into one branch. Hamilton hardly a small government man said in Federalist # 78

Quote:
" The judiciary must ultimately depend upon the aid of the executive arm even for the efficacy of its judgments."
Marshall himself seemed to understand that there wasn't much to back up his claim. He rarely ed used it again sense he feared that the decision would be ignored due to the fact that most still believed that the Court's didn't have the final say in such task. This happened with Andrew Jackson. In the Worcester v. Georgia ruling Jackson famously said
Quote:
"John Marshall has made his decision. Now let him enforce it."
Sense then though time has been on the side of the Judiciary. Know though a huge backlash is growing in anger against this uncontrolled Oligarchy. Many books have come out. Politicians have begun to denounce the Oligarchy (from both left and right but strongly from the right now) and grassroots organization are yelling and screaming for reform. Like the changing of how Senators are selected will there be a huge switch in the power of the Judiciary? I personally, hope and believe so.

Do you really think this will have much of an impact on an election several years from now? As it is, most people are sick of hearing about it, and there are certainly bigger issues. Had the Repubs actually been successful, the Dems may have had more of an issue, but as it is, they tried to extend the life of severely brain damaged woman and failed -- I don't see that influencing a lot of moderates to vote Democrat.

Default In case no one's noticed, this is not about Schiavo

Schiavo?

This is no different than the Amendment to ban gay marriage. It was created and nursed to life for one reason: As a hidden agenda to other issues.

Of course we know now that the Man/Woman Marriage Amendment (and corresponding amendments against the homos across the country), was a method to get the fundamentalist Fristians out to vote. I mean hey, if they aren’t motivated to get in their Buicks to vote against queers, who are they motivated to vote against?

Of course while the queer haters are voting against the queers, why not vote for the king of the queer haters, Bushie?

In this case Schiavo, it was a way to show the Democrats as being in favor of death. And who is in league with the Democrats? That’s right, the evil court system. This was just one more ploy in a long litany of ploys to dupe the American dumb_asses -- too stupid to come inside, out of the acid rain, complements of the clean skies amendment.

The idea here is to rid our country of the 3rd branch of government -- the Judicial branch. Don't believe me? Well I was listening when DeLay et. al. (aka Tony Soprano), Lieutenants of the Bush Crime Family, explain that they were going to de-fund the 9th circuit court and dismantle it. http://barbyawp.blogspot.com/

Don't ever look at the surface when it comes to the GOP and its Neocon agenda. Their actions are never as they first appear. You have to look about 5 moves ahead. Think of it as a chess game being played against your children. You lose, your kids die, we all have fun.

I believe you can read more about this logic in the Rise and Fall of the 3rd Reich. Or you can take a look at this: http://fundamentalbass.home.mindspring.com/x2538.htm

You can also read about where this is going if you take a look at http://www.newamericancentury.org/st...principles.htm

If you remove the UN from any real impact (Bolton) AND you remove the legal foundation of our country (aka little wedge issues that kindle the notion that the court should be dismantled), then you create an environment where you can control much of the ________ (you fill in the blank).

Very clever of Rove. Although he is a minion of Satan, he is one smart SOB.

Of course, much of America is ignorant and will not understand what is happening. America: Little kittens on the farm, purring because they do not understand the burlap bag and bucket of water.

I believe it was Caesar who said, "Give the masses bread and a circus. Then they will be happy."

As long as half of America remains entranced with the circus and the other half believes themselves to be less than 1/16th Jew, then the Neocon agenda will move forward and we will be one step closer to having America living just like Schiavo, kept alive with the Neocon feeding tube in a vegetative state.

Do not let the Schiavo case disappear from your mind. It is but the first brick laid for the impending oven.
