Default Becoming Dictator after declaring National Emergency, How?

What is the process of a President of the United States to extend his term by declaring State of Emergency? He just says, "Hey, National Emergency.", and that's that? Some people sure do make it seem like that, but then again. I don't know how. Does Congress have to approve? Does the Supreme Court have to approve? What is the entire process? If anyone knows, Thank you.

Default .

Not sure myself but, WIKIPEDIA SAYS.

Quote:
Although the President, as head of the executive branch, has the authority to declare a state of emergency, the National Emergencies Act limits the President's ability to declare emergencies by requiring that they expire within two years unless specifically extended, and that the President specify in advance which legal provisions will be invoked. The International Emergency Economic Powers Act allows for the freezing of assets, limiting of trade, and confiscation of property during such an emergency.
Seems that he just says "Extend por favor" and it's done. I'm sure there's some sort of process involving the other branches, though.

Default Dictator - perhaps

The NEA allows as stated - however the War Powers act - could by strict interpertation allow a president to disallow or to not allow the House and the Senate to meet. This done there is no check on the powers and thus a President could - in theory take over.

This is not likely however as the military would be needed - and they/we would not for long

A short time heck yep - indeed it may help.

Sigh One can speculate.
