Nazis' permit to march revoked

[(*)(*)(*)(*)(*)(*)] City Manager Milton Dohoney revoked on Friday a neo-Nazi group’s permit to march April 20 in predominantly black Over-the-Rhine and told organizers they won’t get a new permit unless they agree instead to march on a three-block route downtown.

Now the group says it intends to sue.

A march permit had been issued by the police department allowing the Roanoke, Va.-based American National Socialist Workers Party to March down 13th Street through Over-the-Rhine to Washington Park – but only on the sidewalk, not the street. The permit also prohibited the group from using bullhorns or other sound-amplification devices.

City spokeswoman Meg Olberding said Friday morning that Dohoney has asked the police to modify the permit by changing the route, taking it outside of Over-the-Rhine, where the population is 77 percent African-American, according to the 2000 census. By Friday afternoon, that changed to a revocation of the permit and the announcement of the city’s new rules.

“Moving this route out of the residential neighborhood is absolutely in the best interest of the public’s safety, which is the city’s primary responsibility,” Dohoney said in an e-mailed statement.

To get a new permit, the statement said, the marchers would have to accept this modified route: Central Parkway from Walnut Street west to Elm Street. That’s three blocks. Marchers also would have to stay on the north sidewalk.

The announcement to the press by the city on Friday further raised the ire of the Nazi group, which sent out a racially charged media statement claiming that the city is breaking the law.

“The city cannot ‘re-route’ our march,” said Bill White, the Socialist Workers Party leader. “They can no more order us to walk or not walk down a certain stretch of road than they can order anyone else.”

When the white supremacist group marched in a Toledo neighborhood in October 2005, it sparked rioting and forced the city’s mayor to declare a state of emergency and set a curfew.

The demonstration is planned for the 118th anniversary of Adolf Hitler’s birth.

“We will have an attorney retained in very short order,” White wrote.

The group maintains the city is wasting its time and money – because of further litigation – by attempting to stand in the way of the Nazis.

“This issue has been litigated so many times that I don’t know why the city of Cincinnati is going to waste our time litigating it again,” White said.

Scott Greenwood, a Cincinnati ACLU lawyer, said that if the issue went before a court of law, the city would lose.

“This is black-letter constitutional law,” Greenwood said. “The city cannot go back, after a permit is issued, and say you have to move a march. They would be on very shaky ground, legally. They would almost certainly lose if this goes to court.”

Greenwood said he has worked with the city and the police on the collaborative agreement that grew out of the April 2001 riots in Cincinnati “long enough to know that they are quite capable of protecting both the demonstrators, counter-demonstrators, onlookers and anybody else.”

Cincinnati, Ohio -- The Jewish-financed National Association for the Advancement of Colored People issued a statement today demanding that the City of Cincinnati withdraw all police presence from Over the Rhine during a planned National Socialist march against black crime and permit blacks to riot and commit crimes during the scheduled march period.
"This proves exactly what we've been saying: The all blacks, from the Uncle Toms in the NAACP to the would be African potentates in the Cincinnati city government, to the welfare blacks living on the street and sucking down their forty ounces work together to protect and sustain black crime," ANSWP Commander Bill White stated today, "The blacks in the NAACP are no different from the blacks in the Cincinnati government and no different from the blacks on the street: The think solely in terms of racial interests, and think of nothing except how they can protect their fellow blacks in the commission of crime."

White today also announced that he had retained counsel and that an injunction to compel the city to both grant the permit and provide adequate police presence to security the safety of the marchers -- and of all white people in Over the Rhine -- during the planned rally.

"We are demanding that the government and the police take control of this crime infested Negro neighborhood," White said, "And the fact that the Negroes and the Negro-run police are spending so much effort resisting this shows the exact problems with Jew democracy and Negro rule that we are trying to highlight."

White said that the ANSWP suit will include a claim for damages against the City for civil rights violations as well as claims for attorney fees, costs and injunctive relief.
