Man Says Deportation Could Be 'Death Sentence'
Illegal Immigrant Wants To Keep Calling Omaha Home

    updated 11/14/2011 2:46:29 PM ET 2011-11-14T19:46:29

A man, who's been living in Omaha illegally, said he's in a fight for his very existence. He's facing deportation and he's appealing on the grounds that returning to Mexico would be a death sentence for him.

The man, who wanted to be identified with the pseudonym "Mr. Garcia" for fear of being persecuted in the Latino community, has been living in south Omaha for 10 years. He's a Mexican national, a member of Omaha's gay community and is HIV positive.

Garcia said if he's deported he fears for his life on two fronts; first from physical violence in Mexico's machismo culture. "I will die in my country really fast," he said.

Secondly, from lack of proper HIV medication which he gets for free in the United States for being a research volunteer.

This scum is gonna cost the american taxpayers millions of $ a year in health care. Deport him immediately.

I'm sure he'll even spread some HIV around before he drops. What an asset to America. Let's keep him!

This is a problem for Mexico. It's not a US problem.

This guy needs to be deported, the last message we need to send is that 'fear of machismo' is valid grounds for coming here and staying here.

America's policy should be to deport immediately all illegals with medical problems.

Got that right. All these stinking illegals have a million sob stories about why they should be allowed to stay here and soak the taxpayers. Look at obama's aunt zeituni who was given asylum a year back on grounds that it would be dangerous to return her to kenya even though she's a national hero there because of her nephew.

He should be given two choices: deportation, or a bottle of sleeping pills and a fifth of something 80 proof.

Well especially to the US citizens he spread his fatal disease to. Sadly the Obama administration will see him as a non-criminal and simply allow him to stay due to Obama's executive order to handle deportation on a case by case basis. I'm sure the gay community will thank him for that as the HIV/AIDS crisis continues to ravage their community.

I have no sympathy for this guy. He contracted HIV because he was voluntarily engaging in unsafe activities, and he is living in this country illegally, not paying taxes and living off the dole....and who knows, he might even spread his disease. Goodbye.

I don't think anyone can say that he contracted HIV from unsafe sexual practices. He could well have used all precautions but gotten unlucky.

He should be allowed to stay in the country. He is a human being (although I know that Americans are loathe to consider a Mexican a human being) and if he will die in his home country, then you have a duty to preserve his life.

We don't have a duty to preserve the life of a non-citizen. Deportation is fully within legality and is actually encouraged.

What happens to this guy is up to Mexico, if he's a Mexican citizen.

If he is in your country, you would be horrible people to send him back knowing he could die. He has the right to live. Allow him to live. Help save his life.

A government only has the responsibility to protect its own citizens or the citizens of countries it has occupied.

Since we haven't occupied Mexico (yet anyway), his fate is tied to whatever his home government wants to do with him.

Maybe it's not fair, but that's life.

If a private individual wants to foot the bill for his treatment and go through the trouble of naturalizing him, that's on his/her dime, but our government shouldn't do anything with him other than returning him to Mexico.

I'd rather not set the precedent of, "if you have HIV, come here and get treatment for free."

So he's saying he's scared of Mexican rednecks? Why did gays have to fight for rights here just so he could run from the fight in Mexico?

I wouldn't want people from Mexico flocking to the US to get treatment for their HIV, either. But this man has been in the US for ten years. He has likely been paying taxes, too. He is already having treatment for his illness and it would be cruel to bring a halt to that treatment. If he must be deported, he should also be allowed to continue with his medication.
