Photographer fined by judge for refusing to photograph gay commitment ceremony

    That doesn't sound right to me.

    Which brought to mind:

    I researched as to how it is that gays are a protected class. Where did anyone ever come up with that?

    Was it simply through the Constitutional instruction that we may not prohibit because of sex? But nowhere does it say 'sexual orientation'. It says 'sex', and clearly the word was intended to be understood as 'gender'.

    So who has allowed that 'gender' can cover 'orientation'? Has a gay man changed gender? No.

    Do you refuse to photograph a gay union because the participants are men, or because they're women? No.

    One would refuse to photograph them because that person has one of some number of problems with the concept of homosexuality.

    So where is the Constitutional establishment that "those who prefer sex with the same gender" is a protected class?
    How about smokers? Is THAT a protected class? Or chess players?

    Whence comes the validity of the term 'gay rights'?

    I'm not saying gays shouldn't have rights. I'm saying that there seems to be no foundation for a class of "sexually oriented" people to be 'protected'.

    The photographer is an idiot. From you link...

    All she had to say is we only photograph weddings where people have a marriage license. Obtain a marriage license and give me a call.

    Whats really crazy is how can the Photographer be fined for not wanting to take part in something that the state doesnt even recognize as being something????

    Seems the state needs to fine itself at this point too.

    The idiot photographer got fined for discriminating against gays and being a religious loon.

    All the photographer had to say was we only photograph people with valid marriage certificates. End of story. Going on and on about Christianity and traditional marriage is stupid. It's fine if you are at home but if you do that in a place of business at least get a good lawyer first... you are going to need it.

    She photographs weddings....the state says the gay couple arent a Marriage, or a Civil union, hence wouldnt fit the "wedding" criteria?

    on that part you are correct, and I agree. Just seems fishy to me that while the state doesnt consider this relationship a wedding...a wedding photographer can be fined for the same belief. Seems that state needs to make up it's mind as to how legitimate gay Weddings are, and establish a view of it before punishing others for their views.

    The photographer could have avoided this by saying that they were booked that day, or quoting an outrageous price.

    A business owner in the UNited States is FREE to choose his/her customers, and sexual preference is NO EXCEPTION.

    The judge is COMPLETELY over stepping the court's authority.

    yep, or like Jeb suggested say only with a valid License.

    However perhaps seeing the states stance on this, didnt figure she'd have to?

    The photographer is NOT REQUIRED TO LIE, to "spare the feeelings " of gays...under NO LAW, ANYWHERE.

    SEXUAL PREFERENCE is NOT a protected civil right...ANYWHERE...in these United States.

    The judge should be impeached and disbarred...

    Yeah it's 2012. We all know that if you aren't comfortable with whatever you are saying being played back on video tape at 6pm on MSNBC you probably shouldn't be saying it unless you want the government to go after you.

    The problem was the photographer brought the whole gay thing in. If the photographer said I don't care if you are gay or straight you are required to produce a New Mexico marriage certificate or I can't do the "wedding" she would have probably been fine. But she went on a rant about "gays" and Christianity. You don't win in court with that. Is it fair? I don't know.

    Like I said just ask the "couple" to produce a New Mexico marriage certificate. That's it. No lying involved. No marriage certificate no wedding photography.

    There was NOTHING ILLEGAL in what they did. The judge is bonkers...and will soon be gone from the bench, if there is any ACTUAL "justice"...

    Grokmaster what you and a lot of people on this forum don't realize is you don't live in a fantasy world in your head. You live in the USA in 2012. I have a lot of thoughts and feelings that are not necessarily palatable to one group in society or another. I have learned to live my life and get my way a reasonable amount of the time by watching what I say. That woman could have had a five minute conversation and gotten her way very easily. Instead she decided to shoot her mouth off. Happy?

    I'm into practical solutions not internet rants. There is a very simple way around that law. It did not need to be a Federal case. But sure Grokmaster do what you want. I'm not your boss. If some piece of business comes your way be my guest and rant about gays, Christians, Allah or whatever makes you happy. To be honest you will probably get away with it 95% of the time. The other 5% of the time you will be dealing with someone as fanatical as you are. Then the two of you can enjoy your time in court subsidizing trial lawyers.

    using your logic if someone wanted the company to film porn and they refused on religious beli6efs they would be a loon, seems to me the only loon are the atheists that think that unnatural sex needs to be protected, The judge should be disbarred

    so basically if you do not accept the job of taking pictures for a homsexual marriage you can be forced to do it or fined???? hmmm im for gay rights and all but im not for that.

    The judge over stepped his authority. It's already been ruled that a Muslim cab driver can refuse a fare if they bring alcohol in the cab with them. A pharmacist can refuse to sell birth control to someone, both because it goes against their religious teachings. Gays goes against many Christian teachings. She had every right to refuse to do it. The ruling can be over turned by a higher court.

    I said nothing about "sparing feelings" I said she could have avoided the whole mess. Meaning the court case.

    Well I am not an atheist and I frankly don't really know how I feel about the law.

    You cannot be compelled to "film porn." Porn is actually highly regulated. There is a lot of paperwork that needs to be filled out before anyone regardless of religious orientation can "film porn."

    That's the problem with you guys. All emotion and no FACTS or logic. If you open a audio visual business you need to know the business law governing your activities. This is why I don't think Republicans in general know much about business. If I was this business person that would be a five minute conversation. Actually regardless of my religious beliefs business is business. I would have probably just taken the money and kept my mouth shut. If the KKK wanted to higher me for a large sum of money to do an innocuous bit of business for them I would do it. I've actually done work for all kinds of people I can't stand. It's just business. Hell I've done work for convicted criminals. As long as the money is green and you aren't asking me to help you break the law I'm fine with it. It's business. Nothing personal. I wish our politicians had a more business like mentality. Everyone says vote for Romney because he is a businessman. Well every time he opens his mouth it's gays, contraception, or let's start a war somewhere else. Dude just deal with the business side of things. Fix the (*)(*)(*)(*) post office!
