Texas proposes a law to nullify any federal anti-gun laws

    It appears that the state of Texas is now poised to take a major step in the direction of nullification; which is a state policy that I have long advocated, unabashedly:

    How many states are we up to now?

    The only time Progressives wrap themselves in the 10th amendment is when they're cheering on states to ignore federal drug prohibitions and immigration laws......all other components of their agenda, they want nationalized.

    given that, they won't like this. one bit.

    Oh indeed- just speculation. My guess this will die a quick death and a year from now, he or some other politician in Texas will suggest the same thing to get some air time.

    I find the reverse is all true- the Cons are all for states rights until they don't want a state to be able do something.

    Republican Rep. Steve Toth says his measure also calls for felony criminal charges to be filed against any federal official who tries to enforce the rule in the state.


    Now I am guessing that this abject and complete idiot is not a lawyer, but I am sure that this sort of incredible stupid rhetoric plays well with the drooling masses, and will win him a vote or two mailed in form the single wide.


    It is hard to believe that there are those in this world that counter reactionary stupidity with reactionary stupidity to an exponential factor. Perhaps one day idiots left and right, in this case right, will recognize bad rhetoric when they see it, as Toth is most certainly putting forth.

    Well thats two states. I'll wait to see what tomorrow brings.

    The difference between this and the whole succession thing a few months ago is that the states don't actually need federal approval to do this.

    States have zero right to override federal law. Federal law supersedes states law every single time. To ignore it is illegal and grounds for arrest.

    California thought they could grow legal weed for medicinal purposes...until the Feds shut down the dispenseries. Good luck with your alternate reality, Texas.

    I don't find it "stupid" at all.

    In fact, it is a necessary factor, I believe, in any truly serious use of state nullification of federal edicts...

    I don't think any major gun bills will even make it through the Senate, let alone the House. As a responsible gun owner I would like to see background checks strengthen a bit, not that it will change much crime wise

    That's not true. There are occasions when the Preemption Doctrine does not apply. Federal law on marijuana does not preempt California law on medical marijuana for example. Both sets of law deal with the same subject, but there is no preemption in that case.

    That doesn't mean the states will comply. If the Federal Government made a law that the states won't follow then what are they going to do? Declare martial law in the state, arrest the governor and send in the ATF?

    The federal guberment doesn't enforce federal immigration laws, so I see no problem with states not enforcing federal laws.
